Amend House Bill 3649 by replacing 3 the title with the following: 4 "AN ACT to amend the State Comptroller Act by changing 5 Section 10.05a."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The State Comptroller Act is amended by 9 changing Section 10.05a as follows: 10 (15 ILCS 405/10.05a) (from Ch. 15, par. 210.05a) 11 Sec. 10.05a. Deductions from Warrants and Payments for 12 Satisfaction of Past Due Child Support. At the direction of 13 the Department of Public Aid, the Comptroller shall deduct 14 from a warrant or other payment described in Section 10.05 of 15 this Act, in accordance with the procedures provided therein, 16 and pay over to the State Disbursement Unit established under 17 Section 10-26 of the Illinois Public Aid Code that amount 18 certified as necessary to satisfy, in whole or in part, past 19 due support owed by a person on account of support action 20 being taken by the Department under Article X of the Illinois 21 Public Aid Code, whether or not such support is owed to the -2- LRB9110886DJpcam 1 State, except that the Comptroller shall not make such a 2 deduction for the payment of past due support from a warrant 3 or other payment representing per diem or reimbursement of 4 travel or other work-related expenses. Such deduction shall 5 have priority over any garnishment except that for payment of 6 state or federal taxes. In the case of joint payees, the 7 Comptroller shall deduct and pay over to the State 8 Disbursement Unit the entire amount certified. The 9 Comptroller shall provide the Department with the address to 10 which the warrant or other payment was to be mailed and the 11 social security number of each person from whom a deduction 12 is made pursuant to this Section. 13 (Source: P.A. 91-212, eff. 7-20-99.) 14 Section 99. Effective date. This Act takes effect upon 15 becoming law.".
