1 AN ACT to amend the Illinois Vehicle Code by adding
2 Section 12-613.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 adding Section 12-613 as follows:
7 (625 ILCS 5/12-613 new)
8 Sec. 12-613. Telephone; use of hands free apparatus.
9 (a) The driver of a motor vehicle, other than a motor
10 vehicle of a law enforcement agency, may not use a telephone
11 while operating the motor vehicle unless the telephone is
12 equipped with and the driver uses an apparatus that allows
13 the driver to talk and listen without holding the telephone
14 or its handset or receiver. The driver may not hold or touch
15 the telephone or its handset or receiver while operating the
16 motor vehicle except to enable the apparatus, enter a
17 telephone number, or hang up or turn off the telephone. As
18 used in this Section, "telephone" means a cellular telephone,
19 portable telephone, or other telephone that may be used from
20 within a moving motor vehicle.
21 (b) Violation of subsection (a) of this Section is a
22 petty offense punishable by a fine of $100.
23 (c) A violation of subsection (a) that results in an
24 accident involving bodily injury or property damage is a
25 petty offense punishable by a fine of $250.
