91_HB4589 LRB9111310MWgc 1 AN ACT concerning the compensation of county officers. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Counties Code is amended by changing 5 Sections 4-6001, 4-6002, and 4-6003 as follows: 6 (55 ILCS 5/4-6001) (from Ch. 34, par. 4-6001) 7 Sec. 4-6001. Officers in counties of less than 8 2,000,000. 9 (a) In all counties of less than 2,000,000 inhabitants, 10 the compensation of Coroners, County Treasurers, County 11 Clerks, Recorders and Auditors shall be determined under this 12 Section. The County Board in those counties shall fix the 13 amount of the necessary clerk hire, stationery, fuel and 14 other expenses of those officers. The compensation of those 15 officers shall be separate from the necessary clerk hire, 16 stationery, fuel and other expenses, and such compensation 17 (except for coroners in those counties with less than 18 2,000,000 population in which the coroner's compensation is 19 set in accordance with Section 4-6002) shall be fixed within 20 the following limits: 21 To each such officer in counties containing less than 22 14,000 inhabitants, not less than $13,500 per annum. 23 To each such officer in counties containing 14,000 or 24 more inhabitants, but less than 30,000 inhabitants, not less 25 than $14,500 per annum. 26 To each such officer in counties containing 30,000 or 27 more inhabitants but less than 60,000 inhabitants, not less 28 than $15,000 per annum. 29 To each such officer in counties containing 60,000 or 30 more inhabitants but less than 100,000 inhabitants, not less 31 than $15,000 per annum. -2- LRB9111310MWgc 1 To each such officer in counties containing 100,000 or 2 more inhabitants but less than 200,000 inhabitants, not less 3 than $16,500 per annum. 4 To each such officer in counties containing 200,000 or 5 more inhabitants but less than 300,000 inhabitants, not less 6 than $18,000 per annum. 7 To each such officer in counties containing 300,000 or 8 more inhabitants but less than 2,000,000 inhabitants, not 9 less than $20,000 per annum. 10 (b) Those officers beginning a term of office before 11 December 1, 1990 shall be compensated at the rate of their 12 base salary. "Base salary" is the compensation paid for each 13 of those offices, respectively, before July 1, 1989. 14 (c) Those officers beginning a term of office on or 15 after December 1, 1990 shall be compensated as follows: 16 (1) Beginning December 1, 1990, base salary plus at 17 least 3% of base salary. 18 (2) Beginning December 1, 1991, base salary plus at 19 least 6% of base salary. 20 (3) Beginning December 1, 1992, base salary plus at 21 least 9% of base salary. 22 (4) Beginning December 1, 1993, base salary plus at 23 least 12% of base salary. 24 (c-5) The State shall furnish 2/3 of the total annual 25 compensation to be paid to the coroners, treasurers, clerks, 26 recorders, and auditors. The amounts furnished by the State 27 shall be payable monthly from the State treasury to the 28 county. 29 Each county shall furnish 1/3 of the total annual 30 compensation to be paid to the coroner, treasurer, clerk, 31 recorder, and auditor. 32 (d) In addition to but separate and apart from the 33 compensation provided in this Section, the county clerk of 34 each county, the recorder of each county, and the chief clerk -3- LRB9111310MWgc 1 of each county board of election commissioners shall receive 2 an award as follows: 3 (1) $4,500 per year after January 1, 1998; 4 (2) $5,500 per year after January 1, 1999; and 5 (3) $6,500 per year after January 1, 2000. 6 The total amount required for such awards each year shall be 7 appropriated by the General Assembly to the State Board of 8 Elections which shall distribute the awards in annual lump 9 sum payments to the several county clerks, recorders, and 10 chief election clerks. Beginning December 1, 1990, this 11 annual award, and any other award or stipend paid out of 12 State funds to county officers, shall not affect any other 13 compensation provided by law to be paid to county officers. 14 (e) Beginning December 1, 1990, no county board may 15 reduce or otherwise impair the compensation payable from 16 county funds to a county officer if the reduction or 17 impairment is the result of the county officer receiving an 18 award or stipend payable from State funds. 19 (f) The compensation, necessary clerk hire, stationery, 20 fuel and other expenses of the county auditor, as fixed by 21 the county board, shall be paid by the county. 22 (g) The population of all counties for the purpose of 23 fixing compensation, as herein provided, shall be based upon 24 the last Federal census immediately previous to the election 25 of the officer in question in each county. 26 (Source: P.A. 90-713, eff. 12-1-98.) 27 (55 ILCS 5/4-6002) (from Ch. 34, par. 4-6002) 28 Sec. 4-6002. Coroners in counties of less than 2,000,000. 29 (a) The County Board, in all counties of less than 2,000,000 30 inhabitants, shall fix the compensation of Coroners within 31 the limitations fixed by this Division, and shall appropriate 32 for their necessary clerk hire, stationery, fuel, supplies, 33 and other expenses. The compensation of the Coroner shall be -4- LRB9111310MWgc 1 fixed separately from his necessary clerk hire, stationery, 2 fuel and other expenses, and such compensation shall be fixed 3 within the following limits: 4 To each Coroner in counties containing less than 5,000 5 inhabitants, not less than $4,500 per annum. 6 To each Coroner in counties containing 5,000 or more 7 inhabitants but less than 14,000 inhabitants, not less than 8 $6,000 per annum. 9 To each Coroner in counties containing 14,000 or more 10 inhabitants, but less than 30,000 inhabitants, not less than 11 $9,000 per annum. 12 To each Coroner in counties containing 30,000 or more 13 inhabitants, but less than 60,000 inhabitants, not less than 14 $14,000 per annum. 15 To each Coroner in counties containing 60,000 or more 16 inhabitants, but less than 100,000 inhabitants, not less than 17 $15,000 per annum. 18 To each Coroner in counties containing 100,000 or more 19 inhabitants, but less than 200,000 inhabitants, not less than 20 $16,500 per annum. 21 To each Coroner in counties containing 200,000 or more 22 inhabitants, but less than 300,000 inhabitants, not less than 23 $18,000 per annum. 24 To each Coroner in counties containing 300,000 or more 25 inhabitants, but less than 2,000,000 inhabitants, not less 26 than $20,000 per annum. 27 The population of all counties for the purpose of fixing 28 compensation, as herein provided, shall be based upon the 29 last Federal census immediately previous to the election of 30 the Coroner in question in each county. This Section does not 31 apply to a county which has abolished the elective office of 32 coroner. 33 (b) Those coroners beginning a term of office on or 34 after December 1, 1990 shall be compensated as follows: -5- LRB9111310MWgc 1 (1) Beginning December 1, 1990, base salary plus at 2 least 3% of base salary. 3 (2) Beginning December 1, 1991, base salary plus at 4 least 6% of base salary. 5 (3) Beginning December 1, 1992, base salary plus at 6 least 9% of base salary. 7 (4) Beginning December 1, 1993, base salary plus at 8 least 12% of base salary. 9 "Base salary", as used in this subsection (b), means the 10 salary in effect before July 1, 1989. 11 (c) The State shall furnish 2/3 of the total annual 12 compensation to be paid to each coroner. The amounts 13 furnished by the State shall be payable monthly from the 14 State treasury to the county. 15 Each county shall furnish 1/3 of the total annual 16 compensation to be paid to the coroner. 17 (Source: P.A. 86-962; 86-1028.) 18 (55 ILCS 5/4-6003) (from Ch. 34, par. 4-6003) 19 Sec. 4-6003. Compensation of sheriffs for certain 20 expenses in counties of less than 2,000,000. 21 (a) The County Board, in all counties of less than 22 2,000,000 inhabitants, shall fix the compensation of 23 sheriffs, with the amount of their necessary clerk hire, 24 stationery, fuel and other expenses. The county shall supply 25 the sheriff with all necessary uniforms, guns and ammunition. 26 The compensation of each such officer shall be fixed 27 separately from his necessary clerk hire, stationery, fuel 28 and other expenses, and such compensation shall be fixed 29 within the following limits: 30 To each such sheriff in counties containing less than 31 10,000 inhabitants, not less than $27,000 per annum. 32 To each such sheriff in counties containing 10,000 or 33 more inhabitants but less than 20,000 inhabitants, not less -6- LRB9111310MWgc 1 than $31,000 per annum. 2 To each such sheriff in counties containing 20,000 or 3 more inhabitants but less than 30,000 inhabitants, not less 4 than $34,000 per annum. 5 To each such sheriff in counties containing 30,000 or 6 more inhabitants but less than 60,000 inhabitants, not less 7 than $37,000 per annum. 8 To each such sheriff in counties containing 60,000 or 9 more inhabitants but less than 100,000 inhabitants, not less 10 than $40,000 per annum. 11 To each such sheriff in counties containing 100,000 or 12 more inhabitants but less than 2,000,000 inhabitants, not 13 less than $43,000 per annum. 14 The population of each county for the purpose of fixing 15 compensation as herein provided, shall be based upon the last 16 Federal census immediately previous to the election of the 17 sheriff in question in such county. 18 (b) Those sheriffs beginning a term of office before 19 December 1, 1990 shall be compensated at the rate of their 20 base salary. "Base salary" is the compensation paid for each 21 of those offices, respectively, before July 1, 1989. 22 (c) Those sheriffs beginning a term of office on or 23 after December 1, 1990 shall be compensated as follows: 24 (1) Beginning December 1, 1990, base salary plus at 25 least 3% of base salary. 26 (2) Beginning December 1, 1991, base salary plus at 27 least 6% of base salary. 28 (3) Beginning December 1, 1992, base salary plus at 29 least 9% of base salary. 30 (4) Beginning December 1, 1993, base salary plus at 31 least 12% of base salary. 32 (c-5) The State shall furnish 2/3 of the total annual 33 compensation to be paid to the sheriffs. The amounts 34 furnished by the State shall be payable monthly from the -7- LRB9111310MWgc 1 State treasury to the county. 2 Each county shall furnish 1/3 of the total annual 3 compensation to be paid to the sheriff. 4 (d) In addition to the salary provided for in 5 subsections (a), (b), and (c), beginning December 1, 1998, 6 each sheriff for their additional duties imposed by other 7 statutes or laws shall receive an annual stipend to be paid 8 by the State in the amount of $6,500. 9 (e) No county board may reduce or otherwise impair the 10 compensation payable from county funds to a sheriff if the 11 reduction or impairment is the result of the sheriff 12 receiving an award or stipend payable from State funds. 13 (Source: P.A. 90-713, eff. 12-1-98.)
