91_HB4762 LRB9115065MWpk 1 AN ACT concerning presidential and vice-presidential 2 electors. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by changing 6 Section 21-1 and by adding Section 1-8 as follows: 7 (10 ILCS 5/1-8 new) 8 Sec. 1-8. Awarding presidential and vice-presidential 9 electors. The State's presidential and vice-presidential 10 electors shall be awarded as follows: 11 (1) One to the winner of the popular vote in each 12 congressional district. 13 (2) Two to the winner of the statewide popular 14 vote. 15 (10 ILCS 5/21-1) (from Ch. 46, par. 21-1) 16 Sec. 21-1. Choosing and election of electors of President 17 and Vice-President of the United States shall be in the 18 following manner: 19 (a) In each year in which a President and Vice-President 20 of the United States are chosen, each political party or 21 group in this State shall choose by its State Convention one 22 electorelectorsof President and Vice-President of the 23 United States from each congressional district and such State 24 Convention of such party or group shall also choose 2 25 electors at large,if any are to be appointed for this State26 and such State Convention of such party or group shall by its 27 chairman and secretary certify the total list of such 28 electors together with electors at large so chosen to the 29 State Board of Elections. 30 The filing of such certificate with the Board, of such -2- LRB9115065MWpk 1 choosing of electors shall be deemed and taken to be the 2 choosing and selection of the electors of this State, if such 3 party or group is successful at the polls as herein provided 4 in choosing their candidates for President and Vice-President 5 of the United States. 6 (b) The names of the candidates of the several political 7 parties or groups for electors of President and 8 Vice-President shall not be printed on the official ballot to 9 be voted in the election to be held on the day in this Act 10 above named. In lieu of the names of the candidates for such 11 electors of President and Vice-President, immediately under 12 the appellation of party name of a party or group in the 13 column of its candidates on the official ballot, to be voted 14 at said election first above named in subsection (1) of 15 Section 2A-1.2 and Section 2A-2, there shall be printed 16 within a bracket the name of the candidate for President and 17 the name of the candidate for Vice-President of such party or 18 group with a square to the left of such bracket. Each voter 19 in this State from the several lists or sets of electors so 20 chosen and selected by the said respective political parties 21 or groups, may choose and elect one of such lists or sets of 22 electors by placing a cross in the square to the left of the 23 bracket aforesaid of one of such parties or groups. Placing a 24 cross within the square before the bracket enclosing the 25 names of President and Vice-President shall not be deemed and 26 taken as a direct vote for such candidates for President and 27 Vice-President, or either of them, but shall only be deemed 28 and taken to be a vote for the entire list or set of electors 29 chosen by that political party or group so certified to the 30 State Board of Elections as herein provided. Voting by means 31 of placing a cross in the appropriate place preceding the 32 appellation or title of the particular political party or 33 group, shall not be deemed or taken as a direct vote for the 34 candidates for President and Vice-President, or either of -3- LRB9115065MWpk 1 them, but instead to the Presidential vote, as a vote for the 2 entire list or set of electors chosen by that political party 3 or group so certified to the State Board of Elections as 4 herein provided. 5 (c) Such certification by the respective political 6 parties or groups in this State of electors of President and 7 Vice-President shall be made to the State Board of Elections 8 within 2 days after such State convention. 9 (d) Should more than one certificate of choice and 10 selection of electors of the same political party or group be 11 filed by contesting conventions or contesting groups, it 12 shall be the duty of the State Board of Elections within 10 13 days after the adjournment of the last of such conventions to 14 meet and determine which set of nominees for electors of such 15 party or group was chosen and selected by the authorized 16 convention of such party or group. The Board, after notice to 17 the chairman and secretaries or managers of the conventions 18 or groups and after a hearing shall determine which set of 19 electors was so chosen by the authorized convention and shall 20 so announce and publish the fact, and such decision shall be 21 final and the set of electors so determined upon by the 22 electoral board to be so chosen shall be the list or set of 23 electors to be deemed elected if that party shall be 24 successful at the polls, as herein provided. 25 (e) Should a vacancy occur in the choice of an elector 26 in a congressional district, such vacancy may be filled by 27 the executive committee of the party or group for such 28 congressional district, to be certified by such committee to 29 the State Board of Elections. Should a vacancy occur in the 30 office of elector at large, such vacancy shall be filled by 31 the State committee of such political party or group, and 32 certified by it to the State Board of Elections. 33 (f) Electors shall be awarded to presidential and 34 vice-presidential candidates as provided in Section 1-8. -4- LRB9115065MWpk 1 (Source: P.A. 84-861.)
