91_SB0252eng SB252 Engrossed LRB9101085WHmg 1 AN ACT to amend certain Acts in relation to workplace 2 injuries and diseases. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Workers' Compensation Act is amended by 6 adding Section 18.5 as follows: 7 (820 ILCS 305/18.5 new) 8 Sec. 18.5. Insurance fraud; employer's standing to seek 9 disposal of claim. After an employee has been convicted of an 10 offense involving a fraudulent workers' compensation claim, 11 an employer has standing before the Industrial Commission for 12 the sole purpose of filing and seeking disposal of the claim. 13 14 Section 10. The Workers' Occupational Diseases Act is 15 amended by adding Section 18.5 as follows: 16 (820 ILCS 310/18.5 new) 17 Sec. 18.5. Insurance fraud; employer's standing to seek 18 disposal of claim. After an employee has been convicted of an 19 offense involving a fraudulent claim under this Act, an 20 employer has standing before the Industrial Commission for 21 the sole purpose of filing and seeking disposal of the claim. 22
