91_SB0305 LRB9101403JScs 1 AN ACT to amend the Public Utilities Act by changing 2 Section 8-501. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 8-501 as follows: 7 (220 ILCS 5/8-501) (from Ch. 111 2/3, par. 8-501) 8 Sec. 8-501. Intrastate gas pipelines; extension and 9 interconnection. Whenever the Commission, after a hearing had 10 upon its own motion or upon complaint, shall find that the 11 rules, regulations, practices, equipment, appliances, 12 facilities or service of any public utility, or the methods 13 of manufacture, distribution, transmission, storage or supply 14 employed by it, are unjust, unreasonable, unsafe, improper, 15 inadequate or insufficient, the Commission shall determine 16 the just, reasonable, safe, proper, adequate or sufficient 17 rules, regulations, practices, equipment, appliances, 18 facilities, service or methods to be observed, furnished, 19 constructed, enforced or employed and it shall fix the same 20 by its order, decision, rule or regulation. The Commission 21 shall prescribe rules and regulations for the performance of 22 any service or the furnishing of any commodity of the 23 character furnished or supplied by any public utility. 24 Whenever the Commission shall determine, after a hearing, 25 that the public convenience and necessity requires that 26 interconnection or extension of intrastate gas distribution 27 or transmission pipelines or facilities is necessary to 28 insure that natural gas service is made available to Illinois 29 natural gas customers at rates which are just and reasonable, 30 the Commission shall determine the interconnection or 31 extension of pipelines or facilities which is necessary to -2- LRB9101403JScs 1 provide such service and shall direct that such facilities be 2 established, according to a schedule set by the Commission. 3 The Commission shall direct that any utility supplying 4 natural gas for such interconnection or extension of 5 intrastate gas distribution or transmission pipelines or 6 facilities shall recover all costs and charges related to the 7 interconnection or extension from the utility receiving such 8 gas at no increased cost to the customers of any utility 9 supplying the gas. The Commission is directed to report to 10 the General Assembly by September 20, 1984, detailing its 11 findings and the steps which it has taken to provide for such 12 intrastate interconnections or extensions. 13 (Source: P.A. 84-617.)
