91_SB0374sam001 LRB9102498DHmgam 1 AMENDMENT TO SENATE BILL 374 2 AMENDMENT NO. . Amend Senate Bill 374 as follows: 3 on page 1, by replacing lines 7 through 12 with the 4 following: 5 "Sec. 3.03. Animal torture. 6 (a) A person commits animal torture when that person 7 without legal justification knowingly or intentionally 8 tortures an animal. For purposes of this Section, and 9 subject to subsection (b), "torture" means infliction of or 10 subjection to extreme physical pain, motivated by an intent 11 to increase or prolong the pain, suffering, or agony of the 12 animal. 13 (b) For the purposes of this Section, "animal torture" 14 does not include any death, harm, or injury caused to any 15 animal by any of the following activities: 16 (1) any hunting, fishing, trapping, or other 17 activity allowed under the Wildlife Code, the Wildlife 18 Habitat Management Areas Act, or the Fish and Aquatic 19 Life Code; 20 (2) any alteration or destruction of any animal 21 done by any person or unit of government pursuant to 22 statute, ordinance, court order, or the direction of a 23 licensed veterinarian; -2- LRB9102498DHmgam 1 (3) any alteration or destruction of any animal by 2 any person for any legitimate purpose, including, but not 3 limited to: castration, culling, declawing, defanging, 4 ear cropping, euthanasia, gelding, grooming, neutering, 5 polling, shearing, shoeing, slaughtering, spaying, tail 6 docking, and vivisection; and 7 (4) any other activity that may be lawfully done to 8 an animal.".
