91_SB0490 LRB9105689SMdv 1 AN ACT to amend the Mental Health and Developmental 2 Disabilities Code by changing Section 3-601. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Mental Health and Developmental 6 Disabilities Code is amended by changing Section 3-601 as 7 follows: 8 (405 ILCS 5/3-601) (from Ch. 91 1/2, par. 3-601) 9 Sec. 3-601. Involuntary admission; petition. 10 (a) When a person is asserted to be subject to 11 involuntary admission and in such a condition that immediate 12 hospitalization is necessary for the protection of thesuch13 person or others from physical harm, any person 18 years of 14 age or older may present a petition to the facility director 15 of a mental health facility in the county where the 16 respondent resides or is present, except that if admission is 17 sought to a State-operated mental health facility and the 18 Community Service Area has a participating mental health 19 center, the petition may be presented to the qualified 20 certifier. No person shall be admitted to a State-operated 21 mental health facility until a written statement, as required 22 under Section 3-601.1, recommending admission has been 23 obtained from a qualified certifier, except that if the 24 person asserted to be subject to involuntary admission is 25 presented for admission directly to a State-operated mental 26 health facility or when no qualified certifier is immediately 27 available, the person shall be admitted to the State-operated 28 mental health facility and the participating mental health 29 center shall be notified, as provided in Section 3-603, and 30 shall provide a qualified certifier to conduct a screening 31 within 24 hours. The petition may be prepared by the -2- LRB9105689SMdv 1 facility director of the facility. 2 (b) The petition shall include: 3 1. a detailed statement of the reason for the assertion 4 that the respondent is subject to involuntary admission, 5 including a description of any acts or significant threats 6 supporting the assertion and the time and place of their 7 occurrence; 8 2. the name and address of the spouse, parent, guardian 9 and close relative, or if none, the name and address of any 10 known friend of the respondent. If the petitioner is unable 11 to supply any such names and addresses, he shall state that 12 diligent inquiry was made to learn this information and 13 specify the steps taken; 14 3. the petitioner's relationship to the respondent and a 15 statement as to whether the petitioner has legal or financial 16 interest in the matter or is involved in litigation with the 17 respondent; 18 4. the names, addresses and phone numbers of the 19 witnesses by which the facts asserted may be proved. 20 (Source: P.A. 88-484.)
