91_SB0491 LRB9104278SMpr 1 AN ACT to amend the Mental Health Treatment Preference 2 Declaration Act by changing Section 10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Mental Health Treatment Preference 6 Declaration Act is amended by changing Section 10 as follows: 7 (755 ILCS 43/10) 8 Sec. 10. Declaration of preference or instructions 9 regarding mental health treatment. 10 (1) An adult of sound mind may make a declaration of 11 preferences or instructions regarding mental health 12 treatment. The preferences or instructions may include 13 consent to or refusal of mental health treatment. 14 (2) A declaration for mental health treatment may be 15 invoked within 3 years of its execution unless it is revoked. 16 The authority of a named attorney-in-fact and any alternative 17 attorney-in-fact named in the declaration continues in effect 18 as long as the declaration appointing the attorney-in-fact is 19 in effect or until the attorney-in-fact has withdrawn. If a 20 declaration for mental health treatment has been invoked and 21 is in effect at the expiration of 3 years after its 22 execution, the declaration remains effective until the 23 principal is no longer incapable. 24 (Source: P.A. 89-439, eff. 6-1-96.)
