91_SB0664 SRS91S0001JJcb 1 AN ACT regarding child support. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Marriage and Dissolution of 5 Marriage Act is amended by adding Section 505.3 as follows: 6 (750 ILCS 5/505.3 new) 7 Sec. 505.3. Child support expenses accounting. If a 8 non-custodial parent paying child support under a court order 9 believes the custodial parent, despite having enough money 10 available from child support, the custodial parent's 11 earnings, and any other sources, is not spending enough money 12 to support the minor child, the non-custodial parent may 13 petition the court to order the custodial parent to account 14 for spending on the child's behalf for a designated recent 15 period of time. The court may order an accounting if it 16 finds an accounting is in the best interest of the minor 17 child. 18 If the accounting reveals that the custodial parent is 19 not providing proper support for the child, and the court 20 finds it is in the best interest of the minor child, the 21 court may order that an escrow account be established into 22 which child support payments paid by the non-custodial 23 parents shall be deposited.
