91_SB0671 LRB9106009SMmb 1 AN ACT regarding children. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Public Aid Code is amended by 5 changing Section 4-1 as follows: 6 (305 ILCS 5/4-1) (from Ch. 23, par. 4-1) 7 Sec. 4-1. Eligibility requirements. Financial aid in 8 meeting basic maintenance requirements for a livelihood 9 compatible with health and well-being shall be given under 10 this Article to or in behalf of families with dependent 11 children who meet the eligibility conditions of Sections 12 4-1.1 through 4-1.11. Persons who meet the eligibility 13 criteria authorized under this Article shall be treated 14 equally, provided that nothing in this Article shall be 15 construed to create an entitlement to a particular grant or 16 service level or to aid in amounts not authorized under this 17 Code, nor construed to limit the authority of the General 18 Assembly to change the eligibility requirements or provisions 19 respecting assistance amounts. 20 TheIllinoisDepartment shall advise every applicant for 21 and recipient of aid under this Article of (i) the 22 requirement that all recipients move toward self-sufficiency 23 and (ii) the value and benefits of employment. As a 24 condition of eligibility for that aid, every person who 25 applies for aid under this Article on or after the effective 26 date of this amendatory Act of 1995 shall prepare and submit, 27 as part of the application or subsequent redetermination, a 28 personal plan for achieving employment and self-sufficiency. 29 The plan shall incorporate the individualized assessment and 30 employability plan set out in subsections (d), (f), and (g) 31 of Section 9A-8. The plan may be amended as the recipient's -2- LRB9106009SMmb 1 needs change. The assessment process to develop the plan 2 shall include questions that screen for domestic violence 3 issues and steps needed to address these issues may be part 4 of the plan. If the individual indicates that he or she is a 5 victim of domestic violence, he or she may also be referred 6 to an available domestic violence program. Failure of the 7 client to follow through on the personal plan for employment 8 and self-sufficiency may be a basis for sanction under 9 Section 4-21. TheIllinoisDepartment may implement this 10 paragraph through the use of emergency rules in accordance 11 with Section 5-45 of the Illinois Administrative Procedure 12 Act. For purposes of the Illinois Administrative Procedure 13 Act, the adoption of rules to implement this paragraph shall 14 be considered an emergency and necessary for the public 15 interest, safety, and welfare. 16 The eligibility of persons who, on the effective date of 17 this Code, are receiving aid under Article VI of the 1949 18 Code, for aid under this Article, and the continuity of their 19 grants, shall not be affected by the enactment of this Code. 20 (Source: P.A. 89-6, eff. 3-6-95; 90-17, eff. 7-1-97.)
