1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2JJ.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2JJ as follows:
7 (815 ILCS 505/2JJ new)
8 Sec. 2JJ. Display of taxicab rates.
9 (a) For purposes of this Section, "taxicab" means a
10 vehicle used to transport passengers for hire, except for a
11 limousine as defined in Section 1-139.1 of the Illinois
12 Vehicle Code, a horse drawn vehicle, or a tour service
13 vehicle.
14 (b) The schedule of rates for a taxicab shall be
15 inserted in a frame on the rear of the partition between the
16 front and the rear seat of the taxicab. In addition, the
17 taxicab rates shall be exhibited on the exterior of the
18 taxicab so as to provide public notice of the base rate
19 charges. Rates shall be clearly stated and displayed in an
20 easily readable format.
21 (c) A taxicab operator who attempts to charge a rate
22 greater than the rates provided for in the frame on the rear
23 of the partition between the front and rear seat of the
24 taxicab or than the rates provided on the exterior of the
25 taxicab commits an unlawful practice within the meaning of
26 this Act.
27 (d) Any ordinance contrary to the provisions of this
28 Section issued by a unit of local government, including any
29 home rule unit, is preempted. It is declared to be the law
30 of this State, pursuant to subsection (i) of Section 6 of the
31 Article VII of the Illinois Constitution, that this Section

1 is a limitation on the authority of home rule units to
2 exercise powers concurrently with the State.
