91_SB0843 LRB9105606DHmg 1 AN ACT concerning the Wildlife and Fish Fund. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Fish and Aquatic Life Code is amended by 5 changing Section 1-230 as follows: 6 (515 ILCS 5/1-230) (from Ch. 56, par. 1-230) 7 Sec. 1-230. Wildlife and Fish Fund; disposition of money 8 received. All fees, fines, income of whatever kind or nature 9 derived from hunting and fishing activities on lands, waters, 10 or both under the jurisdiction or control of the Department, 11 and all penalties collected under this Code shall be 12 deposited into the State Treasury and shall be set apart in a 13 special fund to be known as the Wildlife and Fish Fund; 14 except that fees derived solely from the sale of salmon 15 stamps, income from art contests for the salmon stamp, 16 including income from the sale of reprints, and gifts, 17 donations, grants, and bequests of money for the conservation 18 and propagation of salmon shall be deposited into the State 19 Treasury and set apart in the special fund to be known as the 20 Salmon Fund; and except that fees derived solely from the 21 sale of state migratory waterfowl stamps, and gifts, 22 donations, grants and bequests of money for the conservation 23 and propagation of waterfowl, shall be deposited into the 24 State Treasury and set apart in the special fund to be known 25 as the State Migratory Waterfowl Stamp Fund. All interest 26 that accrues from moneys in the Wildlife and Fish Fund, the 27 Salmon Fund, and the State Migratory Waterfowl Stamp Fund 28 shall be retained in those funds respectively. Appropriations 29 from the Wildlife and Fish Fund shall be made only to the 30 Department for the carrying out of the powers and functions 31 vested by law in the Department, including (i) the purchase -2- LRB9105606DHmg 1 of land for fish hatcheries, wildlife refuges, preserves, and 2 public shooting and fishing grounds; (ii) the purchase and 3 distribution of wild birds, the eggs of wild birds, and wild 4 mammals; (iii) the rescuing, restoring and distributing of 5 fish; (iv) the maintenance of wildlife refuges or preserves, 6 public shooting grounds, public fishing grounds, and fish 7 hatcheries; and (v) the feeding and care of wild birds, wild 8 mammals, and fish. Appropriations from the Salmon Fund shall 9 be made only to the Department to be used solely for the 10 conservation and propagation of salmon, including 11 construction, operation, and maintenance of a cold water 12 hatchery, and for payment of the costs of printing salmon 13 stamps, the expenses incurred in acquiring salmon stamp 14 designs, and the expenses of producing reprints. 15 Appropriations from the State Migratory Waterfowl Stamp 16 Fund shall be made only to the Department to be used solely 17 for the following purposes: 18 (a) 50% of funds derived from the sale of State 19 migratory waterfowl stamps and 100% of all gifts, 20 donations, grants, and bequests of money for the 21 conservation and propagation of waterfowl for projects 22 approved by the Department shall be used for the purpose 23 of attracting waterfowl and improving public migratory 24 waterfowl areas within the State. These projects may 25 include the repair, maintenance, and operation of these 26 areas only in emergencies as determined by the State Duck 27 Stamp Committee; but none of the moneys spent within the 28 State shall be used for administrative expenses. 29 (b) 50% of funds derived from the sale of State 30 migratory waterfowl stamps shall be turned over by the 31 Department to appropriate non-profit organizations for 32 the development of waterfowl propagation areas within the 33 Dominion of Canada or the United States that specifically 34 provide waterfowl for the Mississippi Flyway. Before -3- LRB9105606DHmg 1 turning over any moneys from the State Migratory 2 Waterfowl Stamp Fund, the Department shall obtain 3 evidence that the project is acceptable to the 4 appropriate governmental agency of the Dominion of Canada 5 or the United States or of one of its Provinces or States 6 having jurisdiction over the lands and waters affected by 7 the project and shall consult those agencies and the 8 State Duck Stamp Committee for approval before allocating 9 funds. 10 The Department, subject to appropriation, may use moneys 11 transferred to the Wildlife and Fish Fund under subsection 12 (b) of Section 1.28 of the Wildlife Code for any of the 13 purposes for which the proceeds of fees for licenses and 14 permits, from which senior citizens are exempt under this 15 Code, may be used. 16 (Source: P.A. 90-743, eff. 1-1-99.) 17 Section 10. The Wildlife Code is amended by changing 18 Section 1.28 as follows: 19 (520 ILCS 5/1.28) (from Ch. 61, par. 1.28) 20 Sec. 1.28. Fees and fines; deposit in funds. 21 (a) All fees, fines, including bond forfeitures, income 22 of whatsoever kind or nature derived from hunting and fishing 23 activities on lands or waters or both under the jurisdiction 24 or control of the Department, and all penalties collected 25 under this Act shall be deposited in the State Treasury and 26 shall be set apart in a special fund to be known as the 27 "Wildlife and Fish Fund"; except that fees derived solely 28 from the sale of salmon stamps, income from art contests for 29 the salmon stamp, including income from the sale of reprints, 30 and gifts, donations, grants and bequests of money for the 31 conservation and propagation of salmon shall be deposited in 32 the State Treasury and set apart in the special fund to be -4- LRB9105606DHmg 1 known as the "Salmon Fund"; and except that fees derived 2 solely from the sale of state migratory waterfowl stamps, and 3 gifts, donations, grants and bequests of money for the 4 conservation and propagation of waterfowl shall be deposited 5 in the special fund to be known as the "State Migratory 6 Waterfowl Stamp Fund"; and except that, of fees derived 7 solely from the sale of State Habitat Stamps, 64% shall be 8 deposited into the Illinois Habitat Fund, 30% into the State 9 Pheasant Fund, and 6% into the State Furbearer Fund. Income 10 generated from the sale of artwork associated with the State 11 Habitat Stamps shall be deposited into the Illinois Habitat 12 Fund. All interest that accrues from monies deposited into 13 the Wildlife and Fish Fund, the Salmon Fund, the State 14 Migratory Waterfowl Stamp Fund, the State Furbearer Fund, the 15 State Pheasant Fund, and the Illinois Habitat Fund shall be 16 deposited into those funds, respectively. Appropriations from 17 the "Wildlife and Fish Fund" shall be made only to the 18 Department for the carrying out of the powers and functions 19 vested by law in the Department, including but not limited to 20 the purchase of land for fish hatcheries, wildlife refuges, 21 preserves and public shooting and fishing grounds; the 22 purchase and distribution of wild birds, the eggs of wild 23 birds, and wild mammals for rescuing, restoring and 24 distributing fish; the maintenance of wildlife refuges, or 25 preserves, public shooting grounds, public fishing grounds 26 and fish hatcheries; and the feeding and care of wild birds, 27 wild animals and fish. 28 (b) On September 1 of each year, beginning September 1, 29 1999, the State Comptroller and Treasurer shall transfer the 30 sum of $850,000 from the General Revenue Fund to the Wildlife 31 and Fish Fund to offset revenue loss resulting from exempting 32 senior citizens from licensing fees for hunting and fishing 33 in this State. The Department, subject to appropriation, may 34 use the money transferred under this subsection (b) for any -5- LRB9105606DHmg 1 of the purposes for which the proceeds of fees for licenses 2 and permits, from which senior citizens are exempt under this 3 Code, may be used. 4 (Source: P.A. 87-135; 87-1015.) 5 Section 99.
