91_SB0872 LRB9102835DHmgA 1 AN ACT concerning energy efficiency. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Renewable Energy, Energy Efficiency, and 5 Coal Resources Development Law of 1997 is amended by changing 6 Section 6-6 as follows: 7 (20 ILCS 687/6-6) 8 (Section scheduled to be repealed on December 16, 2007) 9 Sec. 6-6. Energy efficiency program. 10 (a)For the year beginning January 1, 1998, and11thereafterAs provided in this Section, each electric 12 utility as defined in Section 3-105 of the Public Utilities 13 Act and each alternative retail electric supplier as defined 14 in Section 16-102 of the Public Utilities Act supplying 15 electric power and energy to retail customers located in the 16 State of Illinois shall contribute annually a pro rata share 17 of a total amount of $3,000,000 for the year beginning 18 January 1, 1998, and $5,000,000 for the year beginning 19 January 1, 1999, and thereafter, based upon the number of 20 kilowatt-hours sold by each such entity in the 12 months 21 preceding the year of contribution. On or before May 1 of 22 each year, the Illinois Commerce Commission shall determine 23 and notify the Department of Commerce and Community Affairs 24 of the pro rata share owed by each electric utility and each 25 alternative retail electric supplier based upon information 26 supplied annually to the Illinois Commerce Commission. On or 27 before June 1 of each year, the Department of Commerce and 28 Community Affairs shall send written notification to each 29 electric utility and each alternative retail electric 30 supplier of the amount of pro rata share they owe. These 31 contributions shall be remitted to the Department of Revenue -2- LRB9102835DHmgA 1 on or before June 30 of each year the contribution is due on 2 a return prescribed and furnished by the Department of 3 Revenue showing such information as the Department of Revenue 4 may reasonably require. The funds received pursuant to this 5 Section shall be subject to the appropriation of funds by the 6 General Assembly. The Department of Revenue shall place the 7 funds remitted under this Section in a trust fund, that is 8 hereby created in the State Treasury, called the Energy 9 Efficiency Trust Fund. If an electric utility or alternative 10 retail electric supplier does not remit its pro rata share to 11 the Department of Revenue, the Department of Revenue must 12 inform the Illinois Commerce Commission of such failure. The 13 Illinois Commerce Commission may then revoke the 14 certification of that electric utility or alternative retail 15 electric supplier. The Illinois Commerce Commission may not 16 renew the certification of any electric utility or 17 alternative retail electric supplier that is delinquent in 18 paying its pro rata share. 19 (b) The Department of Commerce and Community Affairs 20 shall disburse the moneys in the Energy Efficiency Trust Fund 21 to residential electric customers to fund projects which the 22 Department of Commerce and Community Affairs has determined 23 will promote energy efficiency in the State of Illinois. The 24 Department of Commerce and Community Affairs shall establish 25 a list of projects eligible for grants from the Energy 26 Efficiency Trust Fund including, but not limited to, 27 supporting energy efficiency efforts for low-income 28 households, replacing energy inefficient windows with more 29 efficient windows, replacing energy inefficient appliances 30 with more efficient appliances, replacing energy inefficient 31 lighting with more efficient lighting, insulating dwellings 32 and buildings, and such other projects which will increase 33 energy efficiency in homes and rental properties. 34 (c) The Department of Commerce and Community Affairs -3- LRB9102835DHmgA 1 shall establish criteria and an application process for this 2 grant program. 3 (d) The Department of Commerce and Community Affairs 4 shall conduct a study of other possible energy efficiency 5 improvements and evaluate methods for promoting energy 6 efficiency and conservation, especially for the benefit of 7 low-income customers. 8 (e) The Department of Commerce and Community Affairs 9 shall submit an annual report to the General Assembly 10 evaluating the effectiveness of the projects and programs 11 provided in this Section, and recommending further 12 legislation which will encourage additional development and 13 implementation of energy efficiency projects and programs in 14 Illinois and other actions that help to meet the goals of 15 this Section. 16 (Source: P.A. 90-561, eff. 12-16-97; 90-624, eff. 7-10-98.) 17 Section 99. Effective date. This Act takes effect upon 18 becoming law.
