1 AN ACT to amend the Illinois Procurement Code.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Procurement Code is amended by
5 changing Section 53-10 as follows:
6 (30 ILCS 500/53-10)
7 Sec. 53-10. Concessions and leases of State property.
8 (a) Except for property under the jurisdiction of a
9 public institution of higher education, concessions,
10 including the assignment, license, sale, or transfer of
11 interests in or rights to discoveries, inventions, patents,
12 or copyrightable works, may be entered into by the State
13 agency with jurisdiction over the property, whether tangible
14 or intangible.
15 (b) Except for (1) property under the jurisdiction of a
16 public institution of higher education and (2) concessions of
17 less than 15 days, excluding set up and dismantling, per
18 location or event per year when such concessions offer or
19 display exhibits, goods, or services to the general public,
20 all concessions shall be reduced to writing and shall be
21 awarded under the provisions of Article 20, except that the
22 contract shall be awarded to the highest and best bidder or
23 offeror, provided that concessions may be awarded by the
24 Department of Natural Resources and the Illinois Historic
25 Preservation Agency to not-for-profit organizations that are
26 affiliated with or support, promote, or enhance the
27 operations, maintenance, and continuation of the property,
28 programs, or purposes of the agency. The agency shall
29 publish the name and address of the organization in the next
30 timely, practicable volume of the Illinois Procurement
31 Bulletin.

2 Section 99. Effective date. This Act takes effect upon
3 becoming law.
