Amend Senate Bill 1151 by replacing 3 the title with the following: 4 "AN ACT to amend the Illinois Vehicle Code by changing 5 Section 13B-45."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Illinois Vehicle Code is amended by 9 changing Section 13B-45 as follows: 10 (625 ILCS 5/13B-45) 11 Sec. 13B-45. Contracts. 12 (a) The Agency may enter into contracts with one or more 13 responsible parties to construct and operate official 14 inspection stations, provide and maintain approved test 15 equipment, administer tests, certify results, issue emission 16 inspection stickers or certificates, maintain records, train 17 personnel, or provide information to the public concerning 18 the program. 19 These contracts (i) shall be subject to the Illinois 20 Purchasing Act, (ii) may be for a term of up to 9 years, 21 (iii) shall be in writing, and (iv) shall not take effect -2- LRB9106027RCksam 1 until a copy of the contract is filed with the State 2 Comptroller. 3 (b) In preparing its proposals for bidding by potential 4 contractors, the Agency shall endeavor to include provisions 5 relating to the following factors: 6 (1) The demonstrated financial responsibility of 7 the potential contractor. 8 (2) The specialized experience and technical 9 competence of the potential contractor in connection with 10 the type of services required and the complexity of the 11 project. 12 (3) The potential contractor's past record of 13 performance on contracts with the Agency, with other 14 government agencies or public bodies, and with private 15 industry, including such items as cost, quality of work, 16 and ability to meet schedules. 17 (4) The capacity of the potential contractor to 18 perform the work within the time limitations. 19 (5) The familiarity of the potential contractor 20 with the types of problems applicable to the project. 21 (6) The potential contractor's proposed method to 22 accomplish the work required including, where 23 appropriate, any demonstrated capability of exploring and 24 developing innovative or advanced techniques and methods. 25 (7) Avoidance of personal and organizational 26 conflicts of interest prohibited under federal, State, or 27 local law. 28 (8) The potential contractor's present and prior 29 involvement in the community and in the State of 30 Illinois. 31 (c) Any contract for the operation of one or more 32 official inspection stations shall include a provision that 33 the contractor shall not perform emission-related repairs or 34 adjustments to vehicles, other than to the contractor's own -3- LRB9106027RCksam 1 vehicles, necessary to enable vehicles to pass Illinois 2 emission inspections. 3 (d) If a vehicle is damaged by or because of the 4 emission inspection, the owner of the vehicle may bring a 5 civil action in the circuit court of the county in which the 6 inspection occurred and may recover from the contractor 7 treble damages, costs, and attorney's fees. 8 (Source: P.A. 88-533.) 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.".
