91_SB1186 LRB9106170KSsb 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Section 3-815. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Section 3-815 as follows: 7 (625 ILCS 5/3-815) (from Ch. 95 1/2, par. 3-815) 8 Sec. 3-815. Flat weight tax; vehicles of the second 9 division. 10 (a) In addition to the registration fee specified in 11 Section 3-813, and except as provided in Section 3-806.3, 12 every owner of a vehicle of the second division registered 13 under Section 3-813, and not registered under the mileage 14 weight tax under Section 3-818, shall pay to the Secretary of 15 State, for each registration year, for the use of the public 16 highways, a flat weight tax at the rates set forth in the 17 following table, the rates including the $10 registration 18 fee: 19 SCHEDULE OF FLAT WEIGHT TAX 20 REQUIRED BY LAW 21 Gross Weight in Lbs. Z 2232 10 (a-1) A Special Hauling Vehicle is a vehicle or 11 combination of vehicles of the second division registered 12 under Section 3-813 transporting asphalt or concrete in the 13 plastic state or a vehicle or combination of vehicles that 14 are subject to the gross weight limitations in subsection (b) 15 of Section 15-111 for which the owner of the vehicle or 16 combination of vehicles has elected to pay, in addition to 17 the registration fee in subsection (a), $100 to the Secretary 18 of State for each registration year. The Secretary shall 19 designate this class of vehicle as a Special Hauling Vehicle. 20 (b) Except as provided in Section 3-806.3, every camping 21 trailer, motor home, mini motor home, travel trailer, truck 22 camper or van camper used primarily for recreational 23 purposes, and not used commercially, nor for hire, nor owned 24 by a commercial business, may be registered for each 25 registration year upon the filing of a proper application and 26 the payment of a registration fee and highway use tax, 27 according to the following table of fees: 28 MOTOR HOME, MINI MOTOR HOME, TRUCK CAMPER OR VAN CAMPER 29 Gross Weight in Lbs. Any truck used exclusively for the 12 owner's own agricultural, horticultural or livestock raising 13 operations and not-for-hire only, or any truck used only in 14 the transportation for-hire of seasonal, fresh, perishable 15 fruit or vegetables from farm to the point of first 16 processing, may be registered by the owner under this 17 subsectionparagraphin lieu of registration under subsection 18paragraph(a), upon filing of a proper application and the 19 payment of the $10 registration fee and the highway use tax 20 herein specified as follows: 21 SCHEDULE OF FEES AND TAXES 22 Gross Weight in Lbs. VZ 1,192 3 In the event the Secretary of State revokes a farm truck 4 registration as authorized by law, the owner shall pay the 5 flat weight tax due hereunder before operating such truck. 6 Any combination of vehicles having 5 axles, with a 7 distance of 42 feet or less between extreme axles, that are 8 subject to the weight limitations in subsection (a) and (b) 9 of Section 15-111 for which the owner of the combination of 10 vehicles has elected to pay, in addition to the registration 11 fee in subsection (c), $100 to the Secretary of State for 12 each registration year shall be designated by the Secretary 13 as a Special Hauling Vehicle. 14 (d) The number of axles necessary to carry the maximum 15 load provided shall be determined from Chapter 15 of this 16 Code. 17 (e) An owner may only apply for and receive 5 farm truck 18 registrations, and only 2 of those 5 vehicles shall exceed 19 59,500 gross weight in pounds per vehicle. 20 (f) Every person convicted of violating this Section by 21 failure to pay the appropriate flat weight tax to the 22 Secretary of State as set forth in the above tables shall be 23 punished as provided for in Section 3-401. 24 (Source: P.A. 88-403; 88-476; 88-617, eff. 9-9-94; 88-670, 25 eff. 12-2-94; 89-710, eff. 2-14-97.)
