91_SB1187 LRB9102572KSgc 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Sections 12-205 and 12-205.1 and adding Sections 12-205.2 and 3 12-205.3. 4 Be it enacted by the People of the State of Illinois, 5 represented in the General Assembly: 6 Section 5. The Illinois Vehicle Code is amended by 7 changing Sections 12-205 and 12-205.1 and adding Sections 8 12-205.2 and 12-205.3 as follows: 9 (625 ILCS 5/12-205) (from Ch. 95 1/2, par. 12-205) 10 Sec. 12-205. Lamps on other vehicles and equipment. 11 Every vehicle, including animal drawn vehicles, referred to 12 in paragraph (b) of Section 12-101, except for implements of 13 husbandry after December 31, 2002, not specifically required 14 by the provisions of this Article to be equipped with lamps 15 or other lighting devices, shall at all times specified in 16 Section 12-201 of this Act be equipped with at least 2 lamps 17 on the power or towing unit, displaying a white light visible 18 from a distance of not less than 1,000 feet to the front of 19 such vehicle and shall also be equipped with 2 lamps each 20 displaying a red light visible from a distance of not less 21 than 1,000 feet to the rear of such vehicle. 22 Where the towed unit or any load thereon partially or 23 totally obscures the 2 lamps displaying red light to the rear 24 of the towing unit, the rearmost towed unit shall be equipped 25 with 2 lamps displaying red light visible from a distance of 26 not less than 1,000 feet to the rear of such towed unit which 27 are positioned in such a manner as to not obstruct the 28 visibility of the red light to any vehicle operator 29 approaching from the rear of such vehicle or combination of 30 vehicles. 31 Where the 2 lamps displaying red light are not obscured -2- LRB9102572KSgc 1 by the towed unit or its load, then either towing unit or 2 towed unit, or both, may be equipped with the 2 lamps 3 displaying red light as required. 4 The preceding paragraph does not apply to antique 5 vehicles. An antique vehicle shall be equipped with lamps of 6 the same type originally installed by the manufacturer as 7 original equipment and in working order. 8 (Source: P.A. 85-830.) 9 (625 ILCS 5/12-205.1) (from Ch. 95 1/2, par. 12-205.1) 10 Sec. 12-205.1. Implements of husbandry or slow-moving 11 vehicles-Display of amber signal lamp. Every animal drawn 12 vehicle, farm tractor, implement of husbandry and special 13 mobile equipment, except when used for road construction or 14 maintenance within the limits of a construction or 15 maintenance project where traffic control devices are used in 16 compliance with the applicable provisions of the manual and 17 specifications adopted under Section 11-301 of the Illinois 18 Vehicle Code, when operated on a highway during a time when 19 lighted lamps are required by Section 12-201 of this Chapter, 20 shall display to the rear at least one flashing amber signal 21 lamp mounted as high as practicable and of sufficient 22 intensity to be visible for a distance of at least 500 feet 23 in normal sunlight; provided, that only the rearmost vehicle 24 of a combination of vehicles coupled together need display 25 such lamp. The flashing amber signal lamp may be operated 26 lighted during daylight hours when other lamps are not 27 required to be lighted when vehicles authorized in this 28 Section are operated on a highway. 29 Any implement of husbandry that displays the marking or 30 lighting configurations specified in the standards of the 31 American Society of Agricultural Engineers, published as ASAE 32 S279.10 APR98, shall be deemed in compliance with this Code. 33 This Section is inoperative after December 31, 2002. -3- LRB9102572KSgc 1 (Source: P.A. 84-285.) 2 (625 ILCS 5/12-205.2 new) 3 Sec. 12-205.2. Implements of husbandry; lighting and 4 marking requirements. 5 (a) Except as specified in subsections (c) and (d) of 6 this Section, implements of husbandry operated on highways 7 shall display the slow-moving vehicle emblem and other 8 reflective markings as specified in the standards of the 9 American Society of Agricultural Engineers, published as ASAE 10 S279.10 APR98, or may display the markings as specified in 11 any later version of the standards published by that society. 12 Where more than one implement of husbandry is towed behind a 13 power unit, the length of the equipment specified in the 14 standard shall be measured from the point of hitch on the 15 power unit to the extreme rear of the rear-most implement. 16 (b) After December 31, 2002 and except as specified in 17 subsection (c) and (d) of this Section, implements of 18 husbandry operated on highways during the period from 30 19 minutes after sunset to 30 minutes before sunrise shall 20 display and operate those headlamps, tail lamps, and flashing 21 amber signal lamps as specified in the standards of the 22 American Society of Agricultural Engineers, published as ASAE 23 S279.10 APR98, or may display and operate those lamps 24 specified in any later version of the standards published by 25 that society. The lights may be operated at other times of 26 the day when not required by this Code. 27 (c) Those self-propelled implements of husbandry 28 manufactured prior to January 1, 2003 are exempt from the 29 American Society of Agricultural Engineers' standards that 30 require them to have the flashing amber signal lamps and 31 reflective materials mounted within 16" of the left and right 32 extremities of the implement. Instead, those flashing amber 33 signals lamps and reflective materials should be mounted as -4- LRB9102572KSgc 1 near those extremities as possible. 2 (d) Implements of husbandry not originally manufactured 3 with synchronization of the flashing amber signal lamps or 4 turn signals are exempt from the American Society of 5 Agricultural Engineers standards that require them to have 6 the flashing amber signal lamps flash in synchronization or 7 require them to be equipped with turn signals. This 8 exemption extends to any implement of husbandry that was 9 manufactured with those features when it is operated in 10 combination with another implement of husbandry that was so 11 equipped or when it is towed by a vehicle other than an 12 implement of husbandry. 13 (e) Prior to the dates for compliance specified in this 14 Section, an implement of husbandry equipped with those lamps 15 and markings specified in the standards of the American 16 Society of Agricultural Engineers, published as ASAE S279.10 17 APR98, shall satisfy the requirements for lighting and 18 marking in this Code. 19 (625 ILCS 5/12-205.3 new) 20 Sec. 12-205.3. Slow-moving vehicles; display of amber 21 signal lamp. Animal drawn vehicles and special mobile 22 equipment, except when used for road construction or 23 maintenance within the limits of a construction or 24 maintenance project where traffic control devices are used in 25 compliance with the applicable provisions of the manual and 26 specifications adopted under Section 11-301 of this Code, 27 when operated on a highway during a time when lighted lamps 28 are required by Section 12-201 of this Code, shall display to 29 the rear at least one flashing amber signal lamp mounted as 30 high as practicable and of sufficient intensity to be visible 31 for a distance of at least 500 feet in normal sunlight; 32 provided, that only the rearmost vehicle of a combination of 33 vehicles coupled together need display the lamp. The flashing -5- LRB9102572KSgc 1 amber signal lamp may be operated lighted during daylight 2 hours when other lamps are not required to be lighted when 3 vehicles authorized in this Section are operated on a 4 highway. This Section shall not apply to implements of 5 husbandry. This Section applies only after December 31, 6 2002. 7 Section 99. Effective date. This Act takes effect on 8 July 1, 2000.
