Amend Senate Bill 1444, AS AMENDED, 3 with reference to page and line numbers of House Amendment 4 No. 1, on page 1, line 8, by replacing "Act" with "Article 5 and Article 5"; and 6 on page 7, immediately below line 30, by inserting the 7 following: 8 "ARTICLE 30. SOUTHWESTERN ILLINOIS TEACHER'S 9 ACADEMY FOR MATH, SCIENCE, AND TECHNOLOGY 10 Section 30-1. Short title. This Article may be cited as 11 the Southwestern Illinois Teacher's Academy for Math, 12 Science, and Technology Act. 13 Section 30-5. Policy and purposes. It shall be the 14 policy of the State of Illinois to provide excellence in 15 mathematics and science education in order to nourish an 16 informed citizenry, assure technological skills for the work 17 force, and assist in the preparation of professionals to 18 serve the interests of Illinois in such fields as 19 engineering, research, teaching, and computer technology. It 20 shall further be the policy to enlist the support of the -2- LRB9110535NTksam02 1 educational, industrial, and scientific communities in a 2 cooperative effort to provide excellence in science and 3 mathematics education. As a symbol of this cooperative 4 endeavor, there shall be established the Southwestern 5 Illinois Teacher's Academy for Math, Science, and Technology 6 to serve the people of Illinois as a teacher's institution 7 and the school system of the State as a catalyst and 8 laboratory for the advancement of teaching. 9 The Academy shall carry a responsibility to stimulate 10 further excellence for all Illinois schools in mathematics 11 and science. That responsibility may be exercised through 12 any or all of the following means: 13 (1) Stimulating curriculum development and 14 revisions through the collaborative efforts of the 15 interacting institutions involved in the Academy 16 including: universities, secondary schools, the 17 industrial sector, and national laboratories. 18 (2) Providing preservice training sites for persons 19 in preparation for the teaching of science and 20 mathematics. 21 (3) Hosting summer institute opportunities for 22 Illinois teachers modeled after the successful National 23 Science Foundation program prevalent in the 1960s. 24 (4) Offering speakers and programs for teacher 25 institutes and in-service training around the State. 26 (5) Producing videotapes of lectures and 27 experiments for use in the schools of this State. 28 Section 30-10. Establishment, funding, and location. 29 There is hereby created the Southwestern Illinois Teacher's 30 Academy for Math, Science, and Technology, which shall be an 31 institution located at the former Parks College campus site 32 in Cahokia, Illinois. The Academy shall be a State agency, 33 funded by State appropriations, private contributions, and -3- LRB9110535NTksam02 1 endowments. The Academy may offer a program of postsecondary 2 course work to teachers. Minimal fees for students may be 3 charged. 4 The Academy shall annually submit to the Board of Higher 5 Education its budget proposal for the operation and capital 6 needs of the Academy for its next fiscal year. Funding is 7 subject to a separate annual appropriation from the Board of 8 Higher Education. 9 Section 30-15. Board of Trustees. The Southwestern 10 Illinois Teacher's Academy for Math, Science, and Technology 11 shall be governed by a Board of Trustees, which shall consist 12 of the following members: 13 (1) Four ex officio nonvoting members who shall be: 14 the State Superintendent of Education; the Executive 15 Director of the Illinois Community College Board; the 16 Executive Director of the State Board of Higher 17 Education; and the Superintendent of Schools in the 18 school district in which the Academy is located. 19 (2) Three representatives of secondary education, 20 one of whom must be a math or science teacher, appointed 21 by the State Superintendent of Education. 22 (3) Two representatives of higher education, one of 23 whom must be a Dean of Education, appointed by the 24 Executive Director of the Board of Higher Education. 25 (4) Three representatives of the scientific 26 community in Illinois appointed by the Governor. 27 (5) Three representatives of the Illinois private 28 industrial sector appointed by the Governor. 29 (6) Two members representative of the general 30 public at large appointed by the Governor. 31 With the exception of the initial appointments, the 32 members' terms of office shall be for 6 years. At the first 33 meeting members shall draw lots for appointments of 2, 4, or -4- LRB9110535NTksam02 1 6 year initial terms. Vacancies shall be filled for the 2 unexpired portion of the terms by appointment of the officer 3 who appointed the person causing such vacancy. The initial 4 terms shall commence upon appointment and upon expiration of 5 a term, the member shall continue serving until a successor 6 is appointed. The Board shall select a chair from among its 7 members who shall serve a 2-year term as chair. Members shall 8 receive no salary but shall be reimbursed for all ordinary 9 and necessary expenses incurred in performing their duties as 10 members of the Board. 11 Section 30-20. Powers of the Board. 12 (a) The Board of Trustees is hereby authorized to: 13 (1) Accept donations, bequests, or other forms of 14 financial assistance for educational purposes from any 15 public or private person or agency and comply with rules 16 and regulations governing grants from the federal 17 government or from any other person or agency, which are 18 not in contravention of the Illinois Constitution or the 19 laws of the State of Illinois. 20 (2) Purchase equipment and make improvements to 21 facilities necessary for the use of the school, in 22 accordance with applicable law. 23 (3) Adopt, amend, or repeal rules, regulations, and 24 policies necessary or proper for the conduct of the 25 business of the Board. 26 (4) Award certificates for successful completion of 27 programs of study requirements. 28 (5) Select a Director who shall be the chief 29 administrative officer of the Academy and who shall 30 administer the rules, regulations, and policies adopted 31 by the Board pursuant hereto. The Director shall also be 32 the chief administrative officer of the Board and shall 33 be responsible for all the administrative functions, -5- LRB9110535NTksam02 1 duties, and needs of the Board. 2 (6) Determine faculty and staff positions necessary 3 for the efficient operation of the school and select 4 personnel for such positions. 5 (7) Prepare and adopt an annual budget necessary 6 for the continued operation of the school. 7 (8) Enter into contracts and agreements that have 8 been recommended by the Director, in accordance with 9 applicable law, and to the extent that funds are 10 specifically appropriated therefor, with other public 11 agencies with respect to cooperative enterprises and 12 undertaking related to or associated with an educational 13 purpose or program affecting education in the school. 14 This shall not preclude the Board from entering into 15 other such contracts and agreements that it may deem 16 necessary to carry out its duties and functions. 17 (9) Perform such other functions as are necessary 18 to the supervision and control of those phases of 19 education under its supervision and control. 20 (10) The Board shall delegate to the Director such 21 of its administrative powers and duties as it deems 22 appropriate to aid the Director in the efficient 23 administration of his responsibility for the 24 implementation of the policies of the Board. 25 (11) The Academy shall be empowered to lease or 26 purchase real and personal property on commercially 27 reasonable terms for the use of the Academy. Any leases 28 or purchases of real or personal property and any 29 disposition thereof by the Academy must be in compliance 30 with the provisions of The Civil Administrative Code of 31 Illinois and the State Property Control Act. Personal 32 property acquired for the use of the Academy shall be 33 inventoried and disposed of in accordance with the State 34 Property Control Act. -6- LRB9110535NTksam02 1 (b) In addition to the authorities granted herein and 2 any powers, duties, and responsibilities vested by any other 3 applicable laws, the Board shall: 4 (1) Adopt rules, regulations, and policies 5 necessary for the efficient operation of the school. 6 (2) Establish criteria to be used in determining 7 eligibility of applicants for enrollment. 8 (3) Determine subjects to be offered. 9 (4) Pay salaries and expenses, including but not 10 necessarily restricted to facilities, equipment, and 11 supplies of the faculty and staff of the Academy out of 12 funds appropriated or otherwise made available for the 13 operating and administrative expenses of the Board and 14 the Academy. 15 (5) Exercise budgetary responsibility and allocate 16 for expenditure by the Academy and programs under its 17 jurisdiction, all moneys appropriated or otherwise made 18 available for purposes of the Board and of such Academy 19 and programs. 20 (6) Prepare and adopt or approve programs of study 21 and rules, bylaws, and regulations for the government of 22 the school and programs under its jurisdiction. 23 (7) Employ such personnel as may be needed, 24 establish policies governing their employment and 25 dismissal, and fix the amount of their compensation. In 26 the employment, establishment of policies, and fixing of 27 compensation the Board may make no discrimination on 28 account of sex, race, creed, color or national origin. 29 The Academy, its Board of Trustees, and its employees 30 shall be represented and indemnified in certain civil law 31 suits in accordance with "An Act to provide for 32 representation and indemnification in certain civil 33 lawsuits", approved December 3, 1977, as amended. 34 Neither the Academy, nor its officers, employees, or -7- LRB9110535NTksam02 1 Board members shall participate in the creation of any 2 corporation, joint venture, partnership, association, or 3 other organizational entity that exercises, expands, or 4 enhances the powers, duties, or responsibilities of the 5 Academy unless specifically authorized by the General 6 Assembly by law. 7 This Section does not restrict the Academy from creating 8 any organization entity which is within or a part of the 9 Academy.".
