91_SB1838 LRB9113218JMdv 1 AN ACT to amend the Open Meetings Act by changing Section 2 1.02 and adding Sections 2.03-5 and 2.03-10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Open Meetings Act is amended by changing 6 Section 1.02 and adding Sections 2.03-5 and 2.03-10 as 7 follows: 8 (5 ILCS 120/1.02) (from Ch. 102, par. 41.02) 9 Sec. 1.02. For the purposes of this Act: 10 "Meeting" means any gathering of a majority of a quorum 11 of the memberscommissionersof a public body held for the 12 purpose of discussing public business. 13 "Public body" includes all legislative, executive, 14 administrative or advisory bodies of the State, counties, 15 townships, cities, villages, incorporated towns, school 16 districts and all other municipal corporations, boards, 17 bureaus, committees or commissions of this State, and any 18 subsidiary bodies of any of the foregoing including but not 19 limited to committees and subcommittees which are supported 20 in whole or in part by tax revenue, or which expend tax 21 revenue, except the General Assembly and committees or 22 commissions thereof. "Public body" includes tourism boards 23 and convention or civic center boards located in counties 24 that are contiguous to the Mississippi River with populations 25 of more than 250,000 but less than 300,000. "Public body" 26 does not include a child death review team established under 27 the Child Death Review Team Actor an ethics commission,28ethics officer, or ultimate jurisdictional authority acting29under the State Gift Ban Act as provided by Section 80 of30that Act. 31 (Source: P.A. 90-517, eff. 8-22-97; 90-737, eff. 1-1-99; -2- LRB9113218JMdv 1 revised 11-8-99.) 2 (5 ILCS 120/2.03-5 new) 3 Sec. 2.03-5. Copies of Act; Attorney General guide. 4 Each body subject to this Act must maintain a copy of this 5 Act for inspection by the public at each of its meetings and 6 at its principal office. Each body subject to this Act must 7 also maintain a reasonable number of copies of a guide to the 8 provisions of this Act, published by the Attorney General, 9 for distribution to the public free of charge at its 10 principal office and at each of its meetings. 11 (5 ILCS 120/2.03-10 new) 12 Sec. 2.03-10. Posting notice of Act's application. Each 13 body subject to this Act must, prior to and during each of 14 its meetings, prominently post the following public notice on 15 or near the entrance to the room in which the meeting takes 16 place: "THIS MEETING IS SUBJECT TO THE OPEN MEETINGS ACT (5 17 ILCS 120). COPIES OF THE OPEN MEETINGS ACT AND A GUIDE TO 18 ITS PROVISIONS ARE AVAILABLE ON REQUEST AND AT THIS 19 MEETING.". 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
