 1        AN ACT to amend the Criminal Identification Act.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Criminal Identification Act is amended by
 5    changing Section 3.1 as follows:

 6        (20 ILCS 2630/3.1) (from Ch. 38, par. 206-3.1)
 7        Sec. 3.1.  Criminal History Record Information.
 8        (a)  The Department may  furnish,  pursuant  to  positive
 9    identification,  records of convictions simultaneously to the
10    Department of Professional Regulation and  licensed  agencies
11    for   the   purpose  of  meeting  registration  or  licensure
12    requirements under The Private Detective, Private Alarm,  and
13    Private Security Act of 1983.
14        (b)  The  Department  may  furnish,  pursuant to positive
15    identification, records of convictions to the Illinois Liquor
16    Control Commission and to policing bodies of this  State  for
17    the  purpose  of assisting local liquor control commissioners
18    in carrying out their duty to refuse  to  issue  licenses  to
19    persons  specified  in paragraphs (4), (5) and (6) of Section
20    6-2 of The Liquor Control Act of 1934.
21        (c)  The Department  shall  charge  an  application  fee,
22    based  on  actual  costs,  for  the  dissemination of records
23    pursuant  to   this   Section.    Fees   received   for   the
24    dissemination  of  records  pursuant to this Section shall be
25    deposited in the State Police Services Fund.  The  Department
26    is  empowered to establish this fee and to prescribe the form
27    and  manner  for   requesting   and   furnishing   conviction
28    information pursuant to this Section.
29        (d)  Any   dissemination   of  any  information  obtained
30    pursuant to this  Section  to  any  person  not  specifically
31    authorized  hereby  to  receive or use it for the purpose for

 1    which it was disseminated shall  constitute  a  violation  of
 2    Section 7.

 4        Section  99.  Effective date.  This Act takes effect upon
 5    becoming law.
