91_SB1945 LRB9113351JMmb 1 AN ACT in relation to the Governor's powers and duties. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Regulatory Sunset Act is amended by 5 changing Section 5 as follows: 6 (5 ILCS 80/5) (from Ch. 127, par. 1905) 7 Sec. 5. Study and report. The Bureau of the Budget 8 shall study the performance of each regulatory agency and 9 program scheduled for termination under this Act and report 10 annually to the Governor the results of such study, including 11 in the report recommendations with respect to those agencies 12 and programs the Bureau of the Budget determines should be 13 terminated or continued by the State. The Governor shall 14 review the report of the Bureau of the Budget and in each 15 even-numbered year make recommendations to the General 16 Assembly on the termination or continuation of regulatory 17 agencies and programs.The Governor's recommendations shall18be made a part of the State budget submitted to the General19Assembly in even-numbered years.20 (Source: P.A. 90-580, eff. 5-21-98.) 21 Section 10. The Counties Code is amended by changing 22 Section 5-15011 as follows: 23 (55 ILCS 5/5-15011) (from Ch. 34, par. 5-15011) 24 Sec. 5-15011. Construction and maintenance of sewers. 25 Every such county is authorized to construct, maintain, alter 26 and extend its sewers, pipelines, channels, ditches and 27 drains along, upon, under and across any highway, street, 28 alley or public ground in the State as a proper use of 29 highways, but so as not to incommode the public use thereof, -2- LRB9113351JMmb 1 and the right and authority are granted to any such county to 2 construct, maintain and operate any conduits, mainpipe or 3 pipes, wholly or partially submerged, buried, or otherwise, 4 in, upon and along any of the lands owned by the State and 5 under any of the public waters therein; provided, that the 6 extent and location of the lands and waters so to be used and 7 appropriated shall be approved in writing by the appropriate 8 state agencyGovernor, upon application duly made to him9asking for such approval: And provided further, that the 10 rights, permission and authority hereby granted shall be 11 subject to all public rights of commerce and navigation, and 12 to the authority of the United States in behalf of such 13 public rights and also to the right of the State to regulate 14 and control fishing in the public waters. 15 (Source: P.A. 86-962.) 16 Section 15. The School Code is amended by changing 17 Sections 27-18 and 27-20.1 as follows: 18 (105 ILCS 5/27-18) (from Ch. 122, par. 27-18) 19 Sec. 27-18. Arbor and bird day. The last Friday in April 20 is designatedThe Governor shall annually designate by21official proclamation a day in the spring to be knownas 22 "Arbor and Bird Day," to be observed throughout the State as 23 a day for planting trees, shrubs and vines about public 24 grounds, and as a day on which to hold appropriate exercises 25 in the public schools and elsewhere tending to show the value 26 of trees and birds and the necessity for their protection. 27 (Source: Laws 1961, p. 31.) 28 (105 ILCS 5/27-20.1) (from Ch. 122, par. 27-20.1) 29 Sec. 27-20.1. Illinois Law Week. The first full school 30 week in May is designated "Illinois Law Week".The Governor31shall annually designate by official proclamation one week in-3- LRB9113351JMmb 1May to be known as "Illinois Law Week" to be observed2throughout the State to foster the importance of law and the3respect thereof in Illinois.During that week, the public 4 schools may devote appropriate time, instruction, study, and 5 exercises in the procedures of the legislature and the 6 enactment of laws, the courts and the administration of 7 justice, the police and the enforcement of law, citizen 8 responsibilities, and other principles and ideals to promote 9 the importance of government under law in the State. 10 (Source: P.A. 76-1183.) 11 Section 20. The Illinois Diseased Animals Act is amended 12 by changing Section 11 as follows: 13 (510 ILCS 50/11) (from Ch. 8, par. 178) 14 Sec. 11. All claims against the State arising from the 15 slaughter of animals as herein provided for, shall be made to 16 the Department under such rules, not inconsistent with this 17 Act, as the Department may prescribe. 18 The Department shall, after inspection, hearing and 19 inquiry by appraisers, in each case determine the amount 20 which shall be paid on account of the animals so slaughtered, 21 which amount shall be the fair market value in health thereof 22 and not less than the net market value for meat consumption, 23 provided that where the appraisals exceed the net market 24 value for meat consumption in health thereof the payments 25 shall not be in excess of the following amounts: 26 (a) bovine species, for beef, dairy and breeding 27 purposes $300 for any registered animal and $150 for any 28 unregistered animal, but not to exceed an average value of 29 $250 per head for all such registered animals in any herd and 30 not to exceed an average value of $125 per head for such 31 nonregistered animals in any herd; 32 (b) equine species, $500 for any one animal; -4- LRB9113351JMmb 1 (c) swine, $50 per head for grade swine and $100 for any 2 registered purebred animal or any breeding animal upon which 3 a certificate of registration has been issued by an approved 4 inbred livestock registry association; 5 (d) sheep, not to exceed $25 for any unregistered sheep, 6 and not to exceed $75 for any registered sheep. 7 No value other than the market utility value of any such 8 animal shall be allowed or fixed, however, unless a 9 certificate of registration issued by the registry 10 association, of the breed of such animal, recognized by the 11 United States Government, is furnished to the appraisers. The 12 appraisers shall report under oath the value of the animals, 13 together with a statement of the evidence or facts upon which 14 the appraisement is based, and the Department shall certify 15 the appraisementand statement to the Governor for his16approval.If the Governor finds that the appraisers have17proceeded in accordance with law, he shall approve their18appraisement for payment, andThe Comptroller shall, upon 19 presentation of the appraisement to him, draw his warrant 20 upon the State Treasurer for the amount fixed by such 21 appraisers in favor of the owner of the animals; provided, 22 that where Federal authority authorizes the payment of part 23 of the value of such animals the State shall only pay the 24 balance of such appraisement fixed as aforesaid. 25 (Source: P.A. 78-592.) 26 (15 ILCS 45/Act rep.) 27 Section 90. The Small Business Tax Policy Act is 28 repealed. 29 (225 ILCS 705/4.04 rep.) 30 Section 95. The Coal Mining Act is amended by repealing 31 Section 4.04. -5- LRB9113351JMmb 1 Section 99. Effective date. This Act takes effect upon 2 becoming law.
