 1        AN   ACT   to   create   the   Alcohol   Impaired   Minor
 2    Responsibility Act.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  1.   Short  title.  This Act may be cited as the
 6    Alcohol Impaired Minor Responsibility Act.

 7        Section  5.   Responsibility  of  person   who   supplies
 8    alcoholic  liquor  to  a  person  under 18 years of age.  Any
 9    person at least  18  years  of  age  who  willfully  supplies
10    alcoholic liquor to a person under 18 years of age and causes
11    the  impairment  of  such person shall be liable for death or
12    injuries to persons or property caused by the  impairment  of
13    such person.
14        A  person, or the survivor of any person, who is injured,
15    in person or property, by an impaired person under the age of
16    18 has a right of action in his or her own name, jointly  and
17    severally,  for damages (including reasonable attorney's fees
18    and expenses) against any person:
19             (i)  who, by selling, giving or delivering alcoholic
20        liquor causes or contributes to  the  impairment  of  the
21        person under the age of 18; or
22             (ii)  who,  by  permitting  consumption of alcoholic
23        liquor causes, or contributes to, the impairment  of  the
24        person under the age of 18.
25        An action for damages under this Section is barred unless
26    commenced within 2 years after the right of action arises.

27        Section  10.  Applicability.  This Act shall not apply to
28    any person  who  supplies  alcoholic  liquor  pursuant  to  a
29    license issued pursuant to the Liquor Control Act of 1934.

 1        Section  99.  Effective date.  This Act takes effect upon
 2    becoming law.
