 1                       SENATE JOINT RESOLUTION
 2                      CONSTITUTIONAL AMENDMENT

 3        RESOLVED,  BY  THE  SENATE  OF  THE  NINETY-FIRST GENERAL
 4    ASSEMBLY  OF  THE   STATE   OF   ILLINOIS,   THE   HOUSE   OF
 5    REPRESENTATIVES   CONCURRING  HEREIN,  that  there  shall  be
 6    submitted to the  electors  of  the  State  for  adoption  or
 7    rejection  at  the general election next occurring at least 6
 8    months after the adoption of this resolution a proposition to
 9    amend Article V of  the  Illinois  Constitution  by  changing
10    Sections  1,  3,  7,  and  18  and by repealing Section 17 as
11    follows:

12        (ILCON Art. V, Sec. 1)
13    SECTION 1. OFFICERS
14        The Executive Branch shall include a Governor, Lieutenant
15    Governor, Attorney General, Secretary of  State,  Comptroller
16    and  Treasurer  elected  by  the  electors of the State. They
17    shall keep the public records and maintain a residence at the
18    seat of government during their terms of office.

21    SECTION 3. ELIGIBILITY
22        To be eligible to hold the office of Governor, Lieutenant
23    Governor, Attorney General, Secretary of  State,  Comptroller
24    or  Treasurer,  a  person must be a United States citizen, at
25    least 25 years old, and a resident  of  this  State  for  the
26    three years preceding his or her election.

29    SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
30        If  the Attorney General, Secretary of State, Comptroller
31    or Treasurer fails to qualify or if the  his  office  becomes

 1    vacant,  the  Governor  shall fill the office by appointment.
 2    The appointee shall hold office  until  the  elected  officer
 3    qualifies  or  until  a successor is elected and qualified as
 4    may be provided by law and shall not be subject to removal by
 5    the Governor. If the Lieutenant Governor fails to qualify  or
 6    if  the  his  office  becomes  vacant, it shall remain vacant
 7    until the end of the term.

10    SECTION 17. COMPTROLLER - DUTIES (REPEALED)
11        The Comptroller, in accordance with law,  shall  maintain
12    the  State's central fiscal accounts, and order payments into
13    and out of the funds held by the Treasurer.

16    SECTION 18. TREASURER - DUTIES
17        The Treasurer, in accordance with law, shall (i) maintain
18    the State's central fiscal accounts, and order payments  into
19    and out of the funds held by him or her, (ii)  be responsible
20    for  the  safekeeping and investment of monies and securities
21    deposited with him or her, and for  their  disbursement  upon
22    his  or  her order, and (iii) have the duties and powers that
23    may be prescribed by law of the Comptroller.

25                              SCHEDULE
26        A  Comptroller  shall  not  be  elected   in   2002   and
27    thereafter.   This  Constitutional  Amendment otherwise takes
28    effect upon the conclusion of the  term  of  the  Comptroller
29    elected in 1998.
