91_SR0289 LRB9112983OBmg 1 SENATE RESOLUTION 2 WHEREAS, Prosecutorial misconduct undermines public 3 confidence in our criminal justice system; and 4 WHEREAS, While the incidence of prosecutorial misconduct 5 is rare, it is in the public interest that the public have 6 notice of actions taken to investigate and discipline those 7 who engage in this conduct; therefore be it 8 RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL 9 ASSEMBLY OF THE STATE OF ILLINOIS, That we urge the Illinois 10 Supreme Court to adopt rules that: 11 1. Require general notice to the public and 12 personal notice to the alleged victim of public hearings 13 of the Attorney Registration and Disciplinary Commission 14 when the subject of the hearings is the alleged unethical 15 conduct of prosecutors; and 16 2. Require that appellate court judges, when citing 17 prosecutorial misconduct in their opinions, be specific 18 and detail such conduct, and that all opinions citing 19 prosecutorial misconduct be published in full; and be it 20 further 21 RESOLVED, That a copy of this resolution be sent to the 22 Illinois Supreme Court.
