LANG-SCHOENBERG-SKINNER-GASH-FRANKS. (WALSH,T) 30 ILCS 500/50-65 Amends the Illinois Procurement Code. Provides that a contractor who violates the Code, contract specifications, or delivery terms shall, for cause, be suspended permanently unless otherwise provided by law (now, may be suspended for up to 5 years or debarred). HOUSE AMENDMENT NO. 1. Adds reference to: 720 ILCS 5/33E-3 from Ch. 38, par. 33E-3 Deletes everything. Amends the Illinois Procurement Code. Provides that provisions concerning contractor suspension apply to all persons. Provides that a person may be suspended for acts or omissions indicating a lack of integrity or honesty in the conduct of business or the performance of contracts. Provides that persons who are convicted of certain felony offenses are permanently barred from participating in State contracts. Provides that suspension or debarment applies to affiliates of the person suspended or debarred. Provides that a business may not be debarred from participating in certain contracts as the result of a conviction of a principal of the business if the principal is no longer employed by or otherwise involved in that business and (i) the business has been adjudicated not guilty or (ii) the business demonstrates to the chief procurement officer that the offense was not directed or authorized by the business. Amends the Criminal Code of 1961. Provides that a person who is convicted of bid-rigging is permanently barred (now barred for a period of 5 years after the date of conviction) from contracting with the State or a unit of local government.
