STEPHENS-FEIGENHOLTZ-LINDNER-MULLIGAN-MOORE,ANDREA AND BASSI. (SYVERSON) 305 ILCS 5/5-5 from Ch. 23, par. 5-5 Amends the Illinois Public Aid Code. Provides that, notwithstanding any other provision of this Section, a comprehensive tobacco use cessation program that includes purchasing prescription drugs, human biological products, or medical devices approved by the Food and Drug Administration or otherwise legally marketed under the federal Food, Drug and Cosmetic Act or the federal Public Health Service Act for use as smoking cessation therapies or aids shall be covered under the medical assistance program for persons who are otherwise eligible for the program. SENATE AMENDMENT NO. 1. Provides that the tobacco use cessation program shall include purchasing prescription drugs or prescription medical devices approved by the Food and Drug Administration rather than purchasing prescription drugs, human biological products, or medical devices approved by the Food and Drug Administration or otherwise legally marketed under the federal Food, Drug and Cosmetic Act or the federal Public Health Service Act for use as smoking cessation therapies or aids.
