FEIGENHOLTZ-GARRETT-SCHOENBERG-GASH-DAVIS,MONIQUE, LANG AND OSTERMAN. 720 ILCS 5/12-7.1 from Ch. 38, par. 12-7.1 730 ILCS 5/5-5-3 Amends the Criminal Code of 1961 and the Unified Code of Corrections. In the Section concerning the offense of hate crime, replaces the requirement that a person must commit one of the specified offenses "by reason of" the actual or perceived race or other attribute of the victim with the requirement that the person must commit one of the specified offenses "based in whole or in part" upon the actual or perceived race or other attribute of the victim. Adds hate crime to the list of offenses for which a court may not impose a period of probation, a term of periodic imprisonment, or conditional discharge. (Now, a court may not impose those sentences only in the case of a second or subsequent conviction for hate crime when the underlying offense is felony aggravated assault or felony mob action.)
