   SOMMER, WAIT, LAWFER AND MYERS,RICHARD.

(ROSKAM-DUDYCZ-O'MALLEY)

   730 ILCS 5/5-2-4          from Ch. 38, par. 1005-2-4                        

        Amends the Unified Code of Corrections.  Provides that the burden      
   of proof and the burden of going forth with the  evidence  rests  with      
   the defendant or any person on the defendant's behalf (rather than the      
   State)  when  a  hearing  is  held  to  review  the determination of a      
   facility director that a  defendant  who  is  institutionalized  after      
   being  found not guilty by reason of insanity should be transferred to      
   a  non-secure  setting,   discharged,   or   conditionally   released.      
   Effective January 1, 2001.
