GRANBERG. 35 ILCS 505/8 from Ch. 120, par. 424 625 ILCS 5/18c-7401 from Ch. 95 1/2, par. 18c-7401 Amends the Motor Fuel Tax Law. Provides that in addition to other uses, money in the Motor Fuel Tax Fund may be used to compensate the responsible highway authority for the closure of a railroad grade crossing that would otherwise qualify for automatic warning devices. Amends the Illinois Vehicle Code. Provides that the Illinois Commerce Commission may permit the construction of a railroad grade crossing rather than an overpass only if (i) the members believe the public safety and convenience justify the grade crossing and (ii) the con- struction of an overpass is not possible because of funding or en- gineering constraints. Provides that the commission shall attempt to reduce the number of railroad grade crossings, as recommended by the Federal Railroad Administration. Deletes public policy language re- garding railroad grade crossings.
