CAPPARELLI-SAVIANO-ZICKUS-GASH, BUGIELSKI, MCAULIFFE, BRADLEY AND WOJCIK. (RADOGNO) New Act Creates the Factory Built Housing Ombudsman Act administered by the Secretary of State. Requires licenses for manufacturers and installers of factory built homes and establishes license fees. Requires that installer employees meet training requirements. Establishes an ombudsman program whereby owners of factory built homes can complain about home or installation quality. Establishes a review board to review complaints. Repeals the Act 3 years after the effec- tive date. Effective immediately. STATE MANDATES NOTE (Dept. of Commerce and Community Affairs) HB 3928 does not create a State mandate under the State Man- dates Act. FISCAL NOTE (Department of Public Health) While an estimated $2,000,000 will be generated annually (based on 4,000 homes installed annually), no funding is designated to DPH for complaint investigation. Though it is difficult to estimate the number of investigations which would occur, the Department estimates a $400 expense associated with each investigation. HOUSING AFFORDABILITY NOTE (Housing Development Authority) The cost to purchase a factory-built home will increase by $500 per home as a result of per-home fees to be charged to the manufacturer and installer. This will affect a small number of homes purchased in Illinois. There were 3,896 new manufactured homes sold and shipped into Illinois during CY 1999. STATE MANDATES NOTE, H-AM 1 (Dept. of Commerce and Community Affairs) Same as previous State mandates note. HOUSING AFFORDABILITY NOTE, H-AM 1 (Housing Development Auth.) The cost to purchase a manufactured home will increase by $25 per home as a result of per-home fees to be charged to the man- ufacturer and installer. This will affect a small number of homes purchased in Illinois. There were 3,896 new manufactured homes sold and shipped into Illinois during CY 1999. FISCAL NOTE, H-AM 1 (Dept. of Public Health) The Department anticipates an annual revenue of $190,000 that will cover the cost of the administration of this program. HOUSE AMENDMENT NO. 1. Deletes everything. Creates the Manufactured Home Quality Assurance Act. Provides that the Illinois Department of Public Health must administer the Act and is responsible for enforcing federal standards that ensure proper installation of manufactured homes. Provides that home manufacturers and installers must be licensed by the Department, and describes license requirements, duration, and fees. Provides that the Department must serve as a liaison between the various parties likely to be involved in disputes and that the Department must investigate complaints to facilitate their non-binding resolution. Creates the Manufactured Housing Quality Board to advise the Department and describes its membership, member terms, meetings, and compensation to members for travel. Requires the Department to refer Act violations to the Attorney General for enforcement and to promulgate rules to implement the Act. Provides penalties for Act violations. Effective one year after becoming law. SENATE AMENDMENT NO. 1. Adds to the Manufactured Housing Quality Assurance Board an 11th member who works with consumer financing. Deletes a requirement that the Department of Public Health must refer Act violations to the Attorney General. Changes a penalty provision by permitting the Department, instead of the Attorney General, to revoke licenses issued under this Act and by deleting a provision which permits the Attorney General to fine violators of this Act. Adds a provision concerning injunctive relief against installers or manufacturers operating without a valid license. Adds a provision that exempts from this Act individuals who install their own mobile home on their own agricultural land. Preempts home rule powers. Changes the effective date to January 1, 2001. to January 1, 2001. SENATE AMENDMENT NO. 2. Reduces the membership of the Manufactured Housing Quality Assurance Board from 11 to 9 members by eliminating a building official familiar with mobile home installation and one individual who works with consumer financing. Requires certain Board members to be active members of the Illinois Manufactured Housing Association or the Illinois Housing Institute. Requires that Board meetings in addition to those required 3 times each year must be called by the Illinois Department of Public Health instead of by 3 members of the Board. Requires that license revocation under this Act by the Department must be for a violation of this Act.
