HOWARD-DAVIS,MONIQUE-PUGH-SHARP. 20 ILCS 2630/5 from Ch. 38, par. 206-5 730 ILCS 5/5-6-3.1 from Ch. 38, par. 1005-6-3.1 Amends the Criminal Identification Act and the Unified Code of Corrections. Provides for automatic expungement and sealing of arrest and conviction records without the filing of a petition with a court. Provides that the arrest, conviction, and court records of a person who has been convicted of a misdemeanor are expunged and sealed after completion of his or her sentence, provided that the person has not been convicted of a felony or misdemeanor within the previous 2 years, excluding non-DUI traffic violations and any time served in jail by the person and included as a part of the original sentence. Provides that the arrest, conviction, and court records of a person convicted of a Class 4 felony are expunged after completion of the person's sentence if the person has not been convicted of a felony or misdemeanor within the previous 3 years excluding traffic violations and any time served by the person prior to and as a part of sentencing within that period. Provides that the willful failure to comply with an expungement order is a Class A misdemeanor. Effective immediately.
