WINTERS AND MCGUIRE. 720 ILCS 5/12-3.2 from Ch. 38, par. 12-3.2 Amends the Criminal Code of 1961. Provides that domestic battery is a Class 4 felony if the defendant has a prior conviction for first degree murder, second degree murder, involuntary manslaughter, or aggravated battery of a child. Provides that domestic battery is a Class 4 felony if the defendant has any prior conviction for any offense of the level of at least a Class 4 felony committed against a family or household member (rather than just any of the offenses of aggravated battery, stalking, aggravated stalking, unlawful restraint, or aggravated unlawful restraint committed against a family or household member). FISCAL NOTE (Dept. of Corrections) There will be an estimated 24 inmates added to the corrections population, at a cost of $5,278,100 over the first ten years from the date of enactment.
