Lowers the blood alcohol concentration level at which a person with a commercial driver's license operating a commercial motor vehicle is presumed under the influence of alcohol from 0.04 to more than 0.00. Limits application of these provisions to operating commercial motor vehicles in the course of the driver's employment. Provides an exception to the more than 0.00 blood alcohol concentration level if the alcohol concentration is the result of alcohol consumed during a religious service or ceremony or the taking of a prescribed or recommended dosage of a medicine that contains alcohol. Effective immediately. HOUSE AMENDMENT NO. 1. Changes from more than 0.00 to 0.02 or more the alcohol level at which a person with a commercial driver's license operating a commercial motor vehicle is presumed to be under the influence of alcohol. FISCAL NOTE, H-AM 1 (Dept. of Transportation) If this legislation were enacted into law and the Federal Motor Carrier Safety Administration held the 0.02 percent blood alcohol content standard to be incompatible with the Federal Motor Carrier Safety Regulations, Illinois could lose Motor Carrier Safety Assistance Program funds. In FY2000, these funds totaled $3,847,925. In FY 2001, Motor Carrier Safety Assistance Program funds are expected to be in excess of $4 million.
