RAUSCHENBERGER. New Act 30 ILCS 105/5.490 new Creates the Medical Fraud Enforcement Act. Provides that fines imposed for medical fraud shall be deposited into the Medical Fraud Enforcement Fund, a special fund in the State treasury, and used by the Attorney General to combat medical fraud. Provides fines for medical fraud shall be an amount equal to at least 2 times the amount of the fraud. Requires persons who commit medical fraud to make restitution. Provides for the imposition of a medical fraud assessment of not less than 75% of the fine imposed. Grants immunity to persons who report medical fraud. Requires the Department of Professional Regulation to disclose the identity of persons who commit medical fraud.
