RAUSCHENBERGER. 55 ILCS 5/3-9008 from Ch. 34, par. 3-9008 55 ILCS 5/3-9008.1 new Amends the Counties Code. Deletes the current provisions concerning filling a vacancy in the office of State's Attorney. Provides that a majority of the circuit judges may declare a vacancy in the office of State's Attorney. Provides that when a vacancy is declared, an individual designated by the elected State's Attorney shall automatically assume the office. Provides that if no designee has been named by the State's Attorney, a majority of the circuit judges may appoint a competent attorney to fill the office. Provides that the appointment lasts until a new State's Attorney is elected and qualified. Provides that if more than 28 months remain in the State's Attorney's term, the designated or appointed person shall serve until the next general election, at which time a State's Attorney shall be elected for the balance of the unexpired term.
