PARKER-SYVERSON-DUDYCZ. (WINTERS-HOFFMAN-SCOTT-HAMOS-WAIT) 625 ILCS 5/11-501.5 from Ch. 95 1/2, par. 11-501.5 Amends the Vehicle Code. Authorizes the Illinois State Police to conduct a pilot program to establish the effectiveness of pupillometer technology (the measurement of the pupil's reaction to light) as a non-invasive test to detect and measure a driver's possible impairment resulting from alcohol, other drugs or intoxicating compounds. The technology shall also be used to detect fatigue levels of commercial motor vehicle operators. SENATE AMENDMENT NO. 1. Provides that a State Police officer may request that the opera- tor of a commercial motor vehicle have his or her eyes tested with a pupillometer device. Provides that if a State Police officer (rather than a law enforcement officer) believes that a person has been driv- ing under the influence of alcohol or drugs, the officer may (rather than shall) use the pupillometer technology when available. SENATE AMENDMENT NO. 2. Deletes everything. Reinserts the provisions of the original bill and Senate Amendment 1 with changes. Provides that the person may refuse the examination or test. Requires the officer to have the device readily available to avoid undue delays. Effective immediately.
