Provides that the Commerce Commission may assess public utilities for costs the Commission incurs in determining whether damages should be paid by the utility because of power interruptions or fluctuations. Authorizes the Commission to utilize outside consultants. Effective immediately. SENATE AMENDMENT NO. 1. Provides that civil penalties related to the late filing of required documents and taxes are due at the time the late filing is made. Limits penalties to $30,000 per offense and $1,000,000 per continuing violation. Deletes provisions authorizing the Commission to establish penalty schedules. SENATE AMENDMENT NO. 2. Replaces the title and everything after the enacting clause. Amends the Public Utilities Act. Provides that the Commerce Commission may assess public utilities for costs the Commission incurs in determining whether damages should be paid by the utility because of power interruptions or fluctuations. Authorizes the Commission to utilize outside consultants. Establishes a procedure for the imposition and collection of penalties with respect to public utilities other than telecommunications carriers. Provides that the Commerce Commission may compromise civil penalties. Provides that civil penalties related to the late filing of reports, taxes, and other filings shall be paid into the Public Utility Fund. Limits penalties to $30,000 per offense and $500,000 per continuing violation. Deletes provisions authorizing the Commission to establish a penalty schedule. Effective immediately.
