Senate Sponsors: DILLARD-DELEO Short description: WINE & SPIRITS-FAIR DEALING Synopsis of Bill as introduced: Creates the Illinois Wine and Spirits Industry Fair Dealing Act of 1999. Prohibits a supplier, other than an Illinois winery or a winery that has annual case sales in the State of Illinois less than or equal to 10,000 cases per year, from canceling, failing to renew, or terminating an agreement without good cause and, in some circumstances, without prior notification. Provides that a supplier may not, without good cause, fail to renew an agreement on terms then equally available to all of its distributors or alter the terms of an agreement from those terms then equally available to all of its distributors. Provides that no supplier or distributor may cancel, fail to renew, or otherwise terminate an agreement without prior notification, except in certain circumstances. Effective immediately. HOUSE AMENDMENT NO. 1. Adds reference to: New Act Adds provisions creating the Soft Drink Industry Fair Dealing Act. Restricts a supplier of soft drinks from taking certain actions against a soft drink distributor. Requires a supplier to provide a distributor with notice of a cancellation.
