92_HB0240 LRB9201404JSpr 1 AN ACT relating to pharmacies. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Pharmacy Practice Act of 1987 is amended 5 by changing Section 18 as follows: 6 (225 ILCS 85/18) (from Ch. 111, par. 4138) 7 Sec. 18. Record retention. 8 (a) There shall be kept in every drugstore or pharmacy a 9 suitable book, file, or electronic record keeping system in 10 which shall be preserved for a period of not less than 5 11 years the original of every written prescription and the 12 original transcript or copy of every verbal prescription 13 filled, compounded, or dispensed, in such pharmacy; and such 14 book or file of prescriptions shall at all reasonable times 15 be open to inspection to the pharmacy coordinator and the 16 duly authorized agents or employees of the Department. 17 (b) Records kept pursuant to this Section may be 18 maintained in an alternative data retention system, such as 19 a direct digital imaging system, provided that: 20 (1) the records maintained in the alternative data 21 retention system contain all of the information required 22 in a manual record; 23 (2) the data processing system is capable of 24 producing a hard copy of the electronic record on the 25 request of the Board, its representative, or other 26 authorized local, State, or federal law enforcement or 27 regulatory agency; and 28 (3) the digital images are recorded and stored only 29 by means of a technology that does not allow subsequent 30 revision or replacement of the images. 31 As used in this Section, "digital imaging system" means a -2- LRB9201404JSpr 1 system, including people, machines, methods of organization, 2 and procedures, that provides input, storage, processing, 3 communications, output, and control functions for digitized 4 representations of original prescription records. 5 Inpatient drug orders may be maintained within an 6 institution in a manner approved by the Department. 7 (c) A pharmacy may not disclose information in its 8 records in a manner that identifies the physician who 9 authorized a prescription or the person to or for whom a 10 prescription was dispensed, except at the request of the 11 person to or for whom the prescription was dispensed, for the 12 purpose of verifying, refilling, or transferring the 13 prescription, or as provided in subsection (a). A pharmacy 14 may not sell information from its records that identifies 15 physicians, patients, federal drug identification numbers, or 16 the quantities of drugs dispensed. 17 (Source: P.A. 90-253, eff. 7-29-97.)
