92_HB0508enr HB0508 Enrolled LRB9203163DHcs 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Section 3-809 as follows: 6 (625 ILCS 5/3-809) (from Ch. 95 1/2, par. 3-809) 7 Sec. 3-809. Farm machinery, exempt vehicles and 8 fertilizer spreaders - registration fee. 9 (a) Vehicles of the second division having a corn 10 sheller, a well driller, hay press, clover huller, feed mixer 11 and unloader, or other farm machinery permanently mounted 12 thereon and used solely for transporting the same, farm wagon 13 type trailers having a fertilizer spreader attachment 14 permanently mounted thereon, having a gross weight of not to 15 exceed 36,000 pounds and used only for the transportation of 16 bulk fertilizer, and farm wagon type tank trailers of not to 17 exceed 3,0002,000gallons capacity, used during the liquid 18 fertilizer season as field-storage "nurse tanks" supplying 19 the fertilizer to a field applicator and moved on highways 20 only for bringing the fertilizer from a local source of 21 supply to farm or field or from one farm or field to another, 22 or used during the lime season and moved on the highways only 23 for bringing from a local source of supply to farm or field 24 or from one farm or field to another, shall be registered 25 upon the filing of a proper application and the payment of a 26 registration fee of $13 per 2-year registration period. This 27 registration fee of $13 shall be paid in full and shall not 28 be reduced even though such registration is made after the 29 beginning of the registration period. 30 (b) Vehicles exempt from registration under the 31 provisions of Section 3-402.A of this Act, as amended, except HB0508 Enrolled -2- LRB9203163DHcs 1 those vehicles required to be registered under paragraph (c) 2 of this Section, may, at the option of the owner, be 3 identified as exempt vehicles by displaying registration 4 plates issued by the Secretary of State. The owner thereof 5 may apply for such registration plates upon the filing of a 6 proper application and the payment of a registration fee of 7 $13, and this registration shall be valid for a 2 year 8 registration period. This $13 fee shall be paid in full and 9 shall not be reduced even though the application is made 10 after the beginning of the registration period. The 11 application for and display of such registration plates for 12 identification purposes by vehicles exempt from registration 13 shall not be deemed as a waiver or recision of its exempt 14 status, nor make such vehicle subject to registration. 15 (c) Any single unit self-propelled agricultural 16 fertilizer implement, designed for both on and off road use, 17 equipped with flotation tires and otherwise specially adapted 18 for the application of plant food materials or agricultural 19 chemicals, desiring to be operated upon the highways ladened 20 with load shall be registered upon the filing of a proper 21 application and payment of a registration fee of $250. The 22 registration fee shall be paid in full and shall not be 23 reduced even though such registration is made during the 24 second half of the registration year. These vehicles shall, 25 whether loaded or unloaded, be limited to a maximum gross 26 weight of 36,000 pounds, restricted to a highway speed of not 27 more than 30 miles per hour and a legal width of not more 28 than 12 feet. Such vehicles shall be limited to the 29 furthering of agricultural or horticultural pursuits and in 30 furtherance of these pursuits, such vehicles may be operated 31 upon the highway, within a 50 mile radius of their point of 32 loading as indicated on the written or printed statement 33 required by the "Illinois Fertilizer Act of 1961", as 34 amended, for the purpose of moving plant food materials or HB0508 Enrolled -3- LRB9203163DHcs 1 agricultural chemicals to the field, or from field to field, 2 for the sole purpose of application. 3 No single unit self-propelled agricultural fertilizer 4 implement, designed for both on and off road use, equipped 5 with flotation tires and otherwise specially adapted for the 6 application of plant food materials or agricultural 7 chemicals, having a width of more than 12 feet or a gross 8 weight in excess of 36,000 pounds, shall be permitted to 9 operate upon the highways ladened with load. 10 Whenever any vehicle is operated in violation of Section 11 3-809 (c) of this Act, the owner or the driver of such 12 vehicle shall be deemed guilty of a petty offense and either 13 may be prosecuted for such violation. 14 (Source: P.A. 91-37, eff. 7-1-99.) 15 Section 99.
