Amend House Bill 661 on page 1, line 3 9, after "influenza" by inserting "in the resident's medical 4 record"; and 5 on page 1, lines 9 and 10, by deleting "who is age 60 or 6 over"; and 7 on page 1, line 16, after "year" by inserting "or as soon as 8 practicable if vaccine supplies are not available before 9 November 1"; and 10 on page 1, line 19, after "admission" by inserting "or as 11 soon as practicable if vaccine supplies are not available at 12 the time of admission"; and 13 on page 1, by replacing line 20 with "the vaccine is 14 medically contraindicated or the resident has refused the 15 vaccine. In the event that the Advisory Committee on 16 Immunization Practices of the Centers for Disease Control and 17 Prevention determines that dates of administration other than 18 those stated in this Act are optimal to protect the health of 19 residents, the Department is authorized to develop rules to 20 mandate vaccinations at those times rather than the times 21 stated in this Act. -2- LRB9206631LDpram 1 A facility may obtain standing orders from a physician 2 for the annual administration of influenza vaccines to 3 residents."; and 4 on page 1, line 22, by replacing "disease" with "pneumonia in 5 the resident's medical record"; and 6 on page 1, by inserting the following immediately after line 7 31: 8 "(c) No action taken by a facility to administer 9 immunizations pursuant to this Section shall in any way be 10 construed as acceptance of liability on the part of the 11 facility. The facility shall be held harmless from any 12 action by a resident, family member, or other interested 13 party for administering the immunizations as authorized by a 14 physician."; and 15 on page 2, line 6 after "influenza" by inserting "in the 16 resident's medical record"; and 17 on page 2, lines 6 and 7, by deleting "who is age 60 or 18 over"; and 19 on page 2, line 13, after "year" by inserting "or as soon as 20 practicable if vaccine supplies are not available before 21 November 1"; and 22 on page 2, line 16, after "admission" by inserting "or as 23 soon as practicable if vaccine supplies are not available at 24 the time of admission"; and 25 on page 2, by replacing line 17 with "the vaccine is 26 medically contraindicated or the resident has refused the 27 vaccine.
