92_HB0677eng HB0677 Engrossed LRB9204067JMmb 1 AN ACT concerning military leave of absence. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Military Leave of Absence Act is amended 5 by changing Section 1 as follows: 6 (5 ILCS 325/1) (from Ch. 129, par. 501) 7 Sec. 1. Any full-time employee, including officers and 8 employees of a school district, of the State of Illinois, 9 other than an independent contractor, who is a member of any 10 reserve component of the United States Armed Forces or of any 11 reserve component of the Illinois State Militia, shall be 12 granted leave from State or school district employment for 13 any period actively spent in such military service, 14 including: 15 (1) basic training; 16 (2) special or advanced training, whether or not within 17 the State, and whether or not voluntary; and 18 (3) annual training. 19 During such leaves, the employee's seniority and other 20 benefits shall continue to accrue. 21 During leaves for annual training, the employee shall 22 continue to receive his regular compensation as a State or 23 school district employee, except for a school district 24 employee who was offered the chance to attend annual training 25 at a time when school is not in session but chose instead to 26 train during the school session. During leaves for basic 27 training and up to 60 days of special or advanced training, 28 if such employee's compensation for military activities is 29 less than his compensation as a State or school district 30 employee, he shall receive his regular compensation as a 31 State or school district employee minus the amount of his HB0677 Engrossed -2- LRB9204067JMmb 1 base pay for military activities, except for a school 2 district employee who was offered the chance to attend basic 3 training or up to 60 days of special or advanced training at 4 a time when school is not in session but chose instead to 5 train during the school session. 6 (Source: P.A. 82-679.)
