 1        AN ACT in relation to school funding.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The School Code is amended by adding  Sections
 5    17-0.01 and 34-52.9 as follows:

 6        (105 ILCS 5/17-0.01 new)
 7        Sec.  17-0.01.  Elimination  of property taxes for school
 8    funding; Committee on Property Tax Reform.
 9        (a)  Notwithstanding any other law to the contrary, after
10    the 2004 levy year, all school  districts  established  under
11    this Code are prohibited from levying any ad valorem property
12    taxes.
13        (b)  There  is  created  the  Committee  on  Property Tax
14    Reform.  The Committee shall be composed of the following:
15             (1)  The  Director  of  Revenue,  or  his   or   her
16        designee.
17             (2)  The  State  Superintendent of Education, or his
18        or her designee.
19             (3)  One school  superintendent  from  each  of  the
20        following   regions,   all  appointed  by  the  Governor:
21        Chicago; Northwest Illinois; Cook County outside  of  the
22        City  of  Chicago;  counties  contiguous  to Cook County;
23        central Illinois; and southern Illinois.
24             (4)  One representative from the Illinois Federation
25        of Teachers, one from the Illinois Education Association,
26        and one from the Chicago Teachers Union.
27             (5)  Two public members appointed  by  the  Governor
28        with expertise in Illinois school finance.
29             (6)  The Cook County Assessor.
30             (7)  One  supervisor of assessments from each of the
31        following   regions:   northwest    Illinois;    counties

 1        contiguous to Cook County; central Illinois; and southern
 2        Illinois.
 3             (8)  Two  public  members  appointed by the Governor
 4        with expertise in taxation in Illinois.
 5             (9)  Four members of the Senate, 2 appointed by  the
 6        President  of  the Senate and 2 by the Minority Leader of
 7        the   Senate,   and   4   members   of   the   House   of
 8        Representatives, 2 appointed by the Speaker of the  House
 9        of  Representatives  and  2 by the Minority Leader of the
10        House of Representatives.
11             (10)  One  representative  of  the   Illinois   Farm
12        Bureau.
13             (11)  One representative of the Taxpayers Federation
14        of Illinois.
15        (c)  The  Committee shall examine various alternatives to
16    ad valorem property taxes  for  the  funding  of  schools  in
17    Illinois.   The  Committee  shall  hold  hearings open to the
18    public.  The Committee shall issue  a  final  report  to  the
19    Governor  and  the  General  Assembly  no later than March 1,
20    2005.   The  report   shall   set   forth   the   Committee's
21    recommendations  and  include  a  specific plan for replacing
22    funding  for  schools  previously  provided  by  ad   valorem
23    property taxes.
24        (d)  The  Department  of Revenue shall make available the
25    necessary staff required by the Committee.

27        Sec. 34-52.9.  Elimination of ad valorem property  taxes.
28    Notwithstanding any other law to the contrary, after the 2004
29    levy  year,  all  school  districts  established  under  this
30    Article  are  prohibited  from  levying  ad  valorem property
31    taxes.

32        Section 99.  Effective date.  This Act takes effect  upon
