92_HB0899ham001 LRB9205777DHmbam01 1 AMENDMENT TO HOUSE BILL 899 2 AMENDMENT NO. . Amend House Bill 899 as follows: 3 on page 1, by replacing lines 4 through 26 with the 4 following: 5 "Section 5. The Illinois Vehicle Code is amended by 6 changing Sections 1-182 and 11-1414.1 as follows: 7 (625 ILCS 5/1-182) (from Ch. 95 1/2, par. 1-182) 8 Sec. 1-182. School bus. 9 (a) "School bus" means every motor vehicle, except as 10 provided in paragraph (b) of this Section, owned or operated 11 by or for any of the following entities for the 12 transportation of persons regularly enrolled as students in 13 grade 12 or below in connection with any activity of such 14 entity: 15 Any public or private primary or secondary school; 16 Any primary or secondary school operated by a religious 17 institution; or 18 Any public, private or religious nursery school. 19 (b) This definition shall not include the following: 20 1. A bus operated by a public utility, municipal 21 corporation or common carrier authorized to conduct local -2- LRB9205777DHmbam01 1 or interurban transportation of passengers when such bus 2 is not traveling a specific school bus route but is: 3 On a regularly scheduled route for the 4 transportation of other fare paying passengers; 5 Furnishing charter service for the transportation of 6 groups on field trips or other special trips or in 7 connection with other special events; or 8 Being used for shuttle service between attendance 9 centers or other educational facilities. 10 2. A motor vehicle of the First Division. 11 3. A motor vehicle designed for the transportation 12 of not less than 7 nor more than 16 persons that is 13 operated by or for a public or private primary or 14 secondary school, including any primary or secondary 15 school operated by a religious institution, for the 16 purpose of transporting not more than 15 students to and 17 from interscholastic athletic or other interscholastic or 18 school sponsored activities. 19 4. A truck as defined in Section 1-211 when 20 students are being transported within the passenger 21 compartment to a school related instructional program. 22 The number of students being transported may not exceed 23 the number of actual seating positions within the 24 passenger compartment of the truck. 25 (Source: P.A. 89-132, eff. 7-14-95.) 26 (625 ILCS 5/11-1414.1) (from Ch. 95 1/2, par. 11-1414.1) 27 Sec. 11-1414.1. School transportation of students. 28 (a) Every student enrolled in grade 12 or below in any 29 entity listed in paragraph (a) of Section 1-182 of this Code 30 who is transported in a second division motor vehicle owned 31 or operated by or for that entity, in connection with any 32 official activity of such entity, must be transported in a 33 school bus or a bus described in subparagraph (1) of -3- LRB9205777DHmbam01 1 paragraph (b) of Section 1-182. 2 (b) This Section shall not apply to any second division 3 vehicle being used by such entity in a parade, homecoming or 4 similar school activity, or to a truck used in a school 5 related instructional program if authorized by the school 6 board and supervised by the school district, nor to a motor 7 vehicle designed for the transportation of not less than 7 8 nor more than 16 persons while that vehicle is being operated 9 by or for a public or private primary or secondary school, 10 including any primary or secondary school operated by a 11 religious institution, for the purpose of transporting not 12 more than 15 students to and from interscholastic athletic or 13 other interscholastic or school sponsored activities, nor to 14 any truck, as defined in Section 1-211, when students are 15 being transported within the passenger compartment to a 16 school related instructional program. The number of students 17 being transported may not exceed the number of actual seating 18 positions within the passenger compartment of the truck. A 19 school board that authorizes a truck, as defined in Section 20 1-211, to transport students enrolled in grade 12 or below 21 for a school related instructional program shall accept 22 liability for any injury or damage resulting from the 23 transportation of the students. 24 (Source: P.A. 89-132, eff. 7-14-95.) 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.".
