92_HB0909 LRB9203975JMmbA 1 AN ACT concerning procurement. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Procurement Code is amended by 5 adding Section 30-50 as follows: 6 (30 ILCS 500/30-50 new) 7 Sec. 30-50. Illinois FIRST Job Opportunities Initiative. 8 (a) For any construction contract with the value of 9 $1,000,000 or more funded in whole or part by Illinois FIRST 10 funds or by any State funds, the State of Illinois shall post 11 the following information pursuant to the procedures set 12 forth in subsection (c): 13 (1) the approximate number of apprenticeship and 14 journey-level hours that will be required and available 15 for each skilled and unskilled trade to be utilized 16 within any contract and subcontract to be awarded for 17 that project, and any other employment opportunity to be 18 made available pursuant to such contract or subcontract; 19 (2) the approximate period of time during which 20 work on any contract or subcontract will continue, 21 including the approximate beginning date that any 22 employment opportunity will arise pursuant to the 23 contract; 24 (3) the description and location of the 25 construction project; and 26 (4) the specific procedures that must be followed 27 to apply for any employment opportunities arising from 28 the contract or subcontract, including location and hours 29 of any union or other offices. 30 (b) Any prime contractor receiving any construction 31 contract with the value of $1,000,000 or more funded in whole -2- LRB9203975JMmbA 1 or part by Illinois FIRST funds or by any State funds shall, 2 on the date the contract is awarded by the State, supply the 3 Department of Employment Security with the employment 4 information specified in subsection (a); provided that for 5 any subcontract awarded during the duration of the contract, 6 the information specified in subsection (a) shall be provided 7 by the prime contractor on the date the subcontract is 8 awarded. Any such contract shall include the requirement for 9 the prime contractor to supply the information within the 10 timeframes set forth in this subsection. 11 (c) All employment opportunities required to be posted 12 under this Section shall be submitted by a prime contractor 13 to the Department of Employment Security, utilizing forms and 14 procedures developed and made available by the Department. 15 The Department of Employment Security shall, upon receipt of 16 such information from any prime contractor: 17 (1) post the information on a State of Illinois 18 Internet site maintained for that purpose; 19 (2) post the information with the job service 20 program maintained by the State; 21 (3) post the information with all Illinois 22 Employment and Training Centers throughout the State; and 23 (4) provide electronic links to the Illinois 24 Department of Transportation website and the Capital 25 Development Board website where the information, specific 26 to those agencies shall also be posted. 27 In addition, the information provided to the Department 28 of Employment Security shall be provided by the prime 29 contractor or his or her representative to any person who 30 seeks application for employment directly at the job site, 31 and shall be posted in an easily accessible public place on 32 the job site. 33 (d) Any prime contractor awarded a construction contract 34 with the value of $1,000,000 or more, funded in whole or part -3- LRB9203975JMmbA 1 by Illinois FIRST funds or by any State funds, shall submit a 2 monthly report, in addition to regular agency-specific forms, 3 to the State of Illinois that shall include information as to 4 the number of apprenticeship and journey-level hours worked 5 by race and gender in each skilled and unskilled trade on all 6 projects employing skilled or unskilled labor during the 7 preceding month. The Governor shall designate an office 8 within a State agency that shall be responsible for the 9 development and dissemination of a simple reporting form, 10 both in paper and electronic format, to be utilized by prime 11 contractors covered under this Section and shall be further 12 responsible for monitoring compliance with the reporting 13 requirements specified in this subsection. Any report 14 submitted pursuant to this subsection shall be made 15 available, at a nominal charge, to any member of the public 16 who requests a copy. 17 Section 99. Effective date. This Act takes effect upon 18 becoming law.
