 1                     AMENDMENT TO HOUSE BILL 927

 2        AMENDMENT NO.     .  Amend House Bill 927 on page 1, line
 3    5, by replacing "Section 1-30" with "Sections 1-30, 1-35, and
 4    1-40"; and

 5    on page 1,  immediately  below  line  17,  by  inserting  the
 6    following:

 7        "(20 ILCS 801/1-35 new)
 8        Sec. 1-35. Registration of water withdrawals.
 9        (a) On and after January 1,2003, any person who withdraws
10    100,000  gallons  or  more  of water per day from any surface
11    water or groundwater resource of the State must register  the
12    withdrawal  with the Department in accordance with Department
13    rules.   A  person  must  provide,  but  is  not  limited  to
14    providing, the following information to the Department:
15             (1)  The  maximum  daily  withdrawal,  the   monthly
16        average  withdrawal,  and  the monthly average discharge,
17        each expressed in millions of gallons per day.
18             (2)  The  location  points  of  the  withdrawal   or
19        discharge.
20             (3)  The  capacity of each facility used to withdraw
21        water.
22             (4) The location and nature of the use to which  the

 1        person puts the withdrawn water.
 2        (b) A person required to register under subsection (a) is
 3    required   to   periodically   update   the  registration  in
 4    accordance with rules adopted by the Department.

 5        (20 ILCS 801/1-40 new)
 6        Sec. 1-40.  Annual reporting of water withdrawals.
 7        (a) Any person who withdraws 2,000,000 gallons or more of
 8    water per day on average during any 30-day period  commencing
 9    on  or  after  January  1,  2003  from  any  surface water or
10    groundwater  resource  of  the  State  must  annually  report
11    information related to the withdrawal to  the  Department  in
12    accordance with Department rules.  A person must provide, but
13    is  not limited to providing, the actual or estimated average
14    annual and monthly volumes and rate of the withdrawal to  the
15    Department.
16        (b)  The  reporting requirements of subsection (a) are in
17    addition to the registration requirements  of  Section  1-35.
18    Any  person  required to annually report the withdrawal under
19    the terms and conditions of a  State  or  federal  permit  is
20    exempt from the reporting requirements of subsection (a).".
