92_HB0938 LRB9202621MWdv 1 AN ACT concerning municipal property. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Municipal Code is amended by 5 changing 11-76-4 as follows: 6 (65 ILCS 5/11-76-4) (from Ch. 24, par. 11-76-4) 7 Sec. 11-76-4. Sale of personal property. Whenever a 8 city or village incorporated under any general or special 9 law, other than a city or village of 500,000 or more 10 population, owns any personal property which in the opinion 11 of a simple majority of the corporate authorities then 12 holding office, is no longer necessary or useful to, or for 13 the best interests of the city or village, such a majority of 14 the corporate authorities then holding office, at any regular 15 meeting or at any special meeting called for that purpose, 16 (1) by ordinance may authorize the sale of that personal 17 property in such manner as they may designate, with or 18 without advertising the sale, or (2) may authorize any 19 municipal officer to convert that personal property into some 20 other form that is useful to the city or village by using the 21 material in the personal property, or (3) may authorize any 22 municipal officer to convey or turn in any specified article 23 of personal property as part payment on a new purchase of any 24 similar article.However, no article shall be turned in as25part of the purchase price on any purchase except upon26receipt of competitive bids, in such manner as may be27prescribed by ordinance, after notice to all bidders that the28article will be turned over as part of the purchase price.29 In cities or villages of 500,000 or more population, the 30 sale of any such personal property shall be governed by the 31 provisions of Division 10 of Article 8. -2- LRB9202621MWdv 1 (Source: P.A. 88-355.)
