92_HB1673 LRB9202555LDpr 1 AN ACT in relation to gambling. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Code of 1961 is amended by 5 changing Section 28-7 as follows: 6 (720 ILCS 5/28-7) (from Ch. 38, par. 28-7) 7 Sec. 28-7. Gambling contracts void. 8 (a) All promises, notes, bills, bonds, covenants, 9 contracts, agreements, judgments, mortgages, or other 10 securities or conveyances made, given, granted, drawn,or11 entered into, or executed by any person whatsoever, where the 12 whole or any part of the consideration thereof is for any 13 money or thing of value, won or obtained in violation of any 14 Section of this Article are null and void. 15 (b) Any obligation that is void under this Section may 16 be set aside and vacated by any court of competent 17 jurisdiction, upon a complaint filed for that purpose, by the 18 person so granting, giving, entering into, or executing the 19 same, or by his executors or administrators, or by any 20 creditor, heir, legatee, purchaser, or other person 21 interested therein; or if a judgment, the same may be set 22 aside on motion of any person stated above, on due notice 23 thereof given. 24 (c) No assignment of any obligation that is void under 25 this Section may in any manner affect the defense of the 26 person giving, granting, drawing, entering into or executing 27 such obligation, or the remedies of any person interested 28 therein. 29 (d) This Section shall not prevent a licensed owner of a 30 riverboat gambling operation from instituting a cause of 31 action to collect any amount due and owing under an extension -2- LRB9202555LDpr 1 of credit to a riverboat gambling patron as authorized under 2 the Riverboat Gambling Act. 3 (Source: P.A. 87-826.)
