1 AN ACT concerning workers' compensation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Workers' Compensation Act is amended by
5 adding Section 3.5 as follows:
6 (820 ILCS 305/3.5 new)
7 Sec. 3.5. Alcohol or drugs; consideration in coverage.
8 If, at the time of his or her injury or disablement, the
9 alcohol concentration in an employee's blood or breath was
10 0.08 or more based on the definition of blood and breath
11 units in Section 11-501.2 of the Illinois Vehicle Code or
12 there was any amount of a drug, substance, or compound in the
13 person's breath, blood, or urine resulting from the unlawful
14 use or consumption of cannabis listed in the Cannabis Control
15 Act or a controlled substance listed in the Illinois
16 Controlled Substances Act, then the arbitrator shall take
17 that information into consideration in determining whether to
18 recommend to the Commission compensation for his or her
19 injury or disablement under this Act.
